With a defense attorney’s brush, the picture was of a scared kid called “Bobby” who battled drug addiction, a sometimes chaotic home life, and the grief of his father’s death just a few years ago — an image that might be supported by at least two mental health professionals. About 150 people, including Police Chief Mike Navarre and Mayor Carty Finkbeiner, attended the short ceremony. The detective’s widow, Danielle, and their son, Noah, 4, were the first to shovel dirt into the hole where the tree was planted across from the Toledo Police Memorial Garden, the chief said. ... The recommendation about Officer John Harris III came from Assistant Chief Don Kenney after an administrative hearing earlier this month on more than a dozen departmental charges that included multiple counts of dishonesty, subversive conduct, and insubordination. The recommendation was approved by Chief Mike Navarre and needs final approval by city Safety Director Dave Moebius. ... Sherman Powell, 19, was indicted by a Lucas County grand jury on four felony charges — carrying a concealed weapon, possession of crack cocaine, trafficking in cocaine, and obstructing justice — and two misdemeanors — obstructing official business and resisting arrest. Police said Mr. Powell, of 722 Bush St., was with young Jobe when they were stopped in the early morning hours of Feb. 21 by vice Detective Keith Dressel and two other undercover officers in North Toledo. ... "Questions have been asked a lot the last week: Why was a 15-year-old out at 2 a.m.? Why was [the teen] armed with a gun?" the mayor said during a news conference yesterday. Detective Keith Dressel, 35, was shot once in the chest with a 38-caliber handgun, the bullet perforating his heart. From the 5/31/07 DDN: Troy developer can't amend lawsuit involving referendum Dayton Daily News Thursday, May 31, 2007 TROY — A Miami County judge Tuesday denied a Troy developer's request to amend a lawsuit against eight Troy area residents who organized a successful 2005 referendum drive. Common Pleas Judge Jeffrey Welbaum said Troy Land Development will not be allowed to add claims of fraud, breach of contract and destruction of evidence to its suit. Welbaum said the request was not filed in a timely manner and there was no proof the claims were based on new evidence. Troy Land Development filed the complaint last year accusing the residents of defamation, abuse of process, interference with a business relationship and civil conspiracy. The residents worked on a referendum that overturned the Troy City Council's rezoning of 57 acres near Concord Elementary School for the proposed Summerfield housing development. Welbaum earlier dismissed the developer's claims of abuse and interference. The residents counter sued, claiming retaliation. Trial in the suit and counterclaim is to start June 14. Heritage Ohio named Xenia Shoe and Leather's historic facade renovation of 21-25 E. Main St. as the "Best Small Rehabilitation" at its Annual Preservation and Revitalization Awards Ceremony, May 17 in Cincinnati. Xenia City Council recognized the honor at last week's meeting, with Council President Patricia Felton thanking the store's owners for helping spruce up downtown. Timothy Sontag, who along with wife Lynn, moved their business into the century-old building in 1982, gave much of the credit to the Xenia Community Development Department, which provided his business with a deferred loan with funding from a federal community development block grant in 2006. Bringing a little country to the city Dayton Daily News, 5/31/07 Starting next week, people won't have to leave the city limits to get a taste of nature. Instead, they can drive down Dorset Road to the Miami County Park District's new Hobart Urban Nature Preserve. The 80-acre preserve is a work in progress, but is far enough along to open to visitors, said Jerry Eldred, park district executive director. "We are bringing a little of the country to the city, a bit of what people who live in rural areas experience every day," Eldred said. The nature preserve started taking shape a decade ago when members of Troy's Hobart, Howell and Bravo families donated 80 acres of undeveloped land that lies behind properties that front Dorset Road, Ridge Avenue, Main Street and McKaig Avenue.

Madisonville: NuTone redevelopment Building Cincinnati, 5/29/07 Site plan The Economic Development Committee will hold a public hearing on June 5 regarding a rezoning of the former NuTone headquarters at Red Bank and Madison in Madisonville. The request, from Miller Valentine Group, would rezone the property as a Planned Development District (PD). The City Planning Commission has already approved of the reclassification and of the development's concept plan. Miller Valentine is proposing a $90 million mixed-use project on the 30-acre site at 4820 Red Bank Road. Though no tenants have been named and the plan is still preliminary, Miller Valentine has a rough idea of what they want for the site. In their plans are four office buildings (3 over 50,000 SF), three multi-family residential buildings (all 3 stories, 23,750 SF), six outlots for restaurants and other retail uses (1,800-6,600 SF) and a four-story hotel, which the Cincinnati Business Courier has noted would contain 100 to 125 rooms. Fifteen hundred parking spaces would be provided on surface lots. (BOO!) How much funding will be needed for the project is not yet known. The site contains seven industrial buildings totalling about 800,000 square feet of space. Tax Increment Financing (TIF) money from the pre-existing Oakley TIF could possibly be used to demolish the buildings and make other site improvements. The sale of the property from NuTone to Miller Valentine is contingent on Council's approval. Miller Valentine plans to close by this summer. The project will likely be on City Council's agenda on June 6 or June 13. If all goes according to script, demolition could begin by late 2007 and last until fall 2008. The phased development would start with the retail component first, with office and residential phased in according to market demand. "What we would like to do is work with the community to help beat this store," Bill Dudley, a United Food and Commercial Workers Union Local 1099 member, told more than 100 residents who attended a meeting Wednesday in an American Legion hall. Dudley, the union's director of strategic operations, told residents the union would help them organize, hire an attorney, and provide other support in hopes of stopping Wal-Mart from building the store at U.S. 42 and Weaver Road. Callahan Staff Writer Thursday, May 31, 2007 Administrator Dan Evers said the Deerfield Twp. moratorium on building was administrative in nature and therefore not subject to zoning procedures. However, even the Ohio Attorney General and the local government section of the Ohio Auditor's office could not say for certain the moratorium was properly placed. Deerfield trustees voted to place a year-long building ban on the north side of Fields Ertel Road while the township completes its comprehensive plan. Living closer than lakefront Local marinas join in trend of offering homes on barges By KRISTINA SMITH Staff writer PORT CLINTON -- Two local marinas have joined a growing market for waterfront living by offering houses on barges. Coastal Marine II and Lakefront Marina on Lakeshore Drive are selling various types of homes that would be docked at their marinas. Floating homes are popular in communities on the East and West coasts and in Key West, Fla., he said. A developer began building them last year at Marine Max on Catawba Island. "The price of waterfront property is rising," said Bob Faflik, Lakefront Marina owner. "This is a very affordable way that a family or a retired person can have a summer home and live, not just near the water, but on the water." From the 5/31/07 Findlay Courier: Dairy's plans concern neighbors By JOHN GRABER STAFF WRITER MILTON CENTER -- Brian Simpson doesn’t feel the Manders dairy should be allowed to expand its operations to three times its current size when it is so close to Weston Elementary School. He’s afraid the odors emanating from the farm, which once expanded will be considered a concentrated animal feeding operation (CAFO), will affect the health of the children in the school about three miles away. The farm, located at 11190 Range Line Road, Weston, currently operates with 690 cows -- 10 under the limit to be regulated as a CAFO. However, Manders is looking to expand the operation to 2,100 cows. That means it would create 26 million gallons of liquid manure and 13,800 tons of sand and separated solids annually. The plant was third out of 10 in its category, behind Daimler Chrysler Jefferson North in Detroit, which spent 19.88 hours per vehicle, and Daimler Chrysler Toledo North, at 20.11 hours per vehicle, in the Harbour Report North America 2007 released Thursday. The commission approved changes to architectural home plans and to signs in two local subdivisions, and gave short-term permission to keep an "illegal" window already installed in a model home. The New Albany Architectural Review Board had recommended that planning commission pass all five measures at its May 14 meeting. Planning commission approved requests from Showcase Homes concerning two model homes in the Windsor subdivision, a 73-plus acre development currently under construction just east of the village center. The development lies between High Street (state Route 605) and Main Street (U.S. Route 62), south of the state Route 161 expressway.
