^ Similar to speed and red light you can try and challenge that you were not the driver, but the principle surrounding tolls is different than speed or red light cameras. Tolls are contractual. You essentially enter into a contract to drive on the road, with that car for the privilege of paying a fee. If you don't want to pay the fee, you will have to take a different route. By entering on that road, you have contracted to pay the fee. It is the same concept with parking meters. With speed cameras, there is no implied contractual agreement that is created so drivers have more rights that apply in these situations. the only implied contract is that you have the right to use the roads in a safe and reasonable manner. Enforcement is not contractual. Speed cameras and red light cameras fall into the enforcement category. This is where individual rights come into play

There is a big difference between a toll bridge and speed cameras, legally speaking. With tolls, you are essentially contracting to cross the bridge and pay a fee to do it. When you get fined for skipping the toll, you have an open and obvious stopping point (toll booth) and you do have an opportunity to cure, in the event the toll was assessed improperly. You do not have a chance to cure with speed cameras or red light cameras. Plus, tolls are essentially a contract, speeding cameras are entrapment.

What about when you lend your car to someone and they speed and you get the ticket in the mail? I don't think you would like that too much. The one key characteristic which is troubling, and the way the laws have met constitutional muster so far (which I feel their day of reckoning is coming) is that tickets issued by cameras are nto moving violations and you do not get points for them on your license, whereas if an officer gave you the same ticket you would get 2 points. This clearly shows that speed and red light cameras are not about protecting the public and discouraging speeding but about generating revenue. Otherwise, if discouraging speeding were the chief concern, they would be placing points on the license and calling it a moving violation.

Speed cameras are more scary than Red Light. Often times you cant tell if the machine is calibrated correctly and there is no discretion for time of day and conditions. Your car speedometer could be 1-2 MPH off and you get a ticket. Most officers use their discretion in this case. THey did a test on the speed cameras in the CIncy area a few years back and they were so off on their calibration they were effectively stealing money from motorists.

It is the right to confront your accuser. If you challenge a speeding ticket, the cop has to appear in court or else it gets dismissed. WIth traffic cameras, you have no ability to confront your accuser. That is a constitutional violation first and foremost. Bottom line, this is a losing battle for the cities, they just need to back down. THis has nothing to do with public safety, it is all about raising revenue. The city of Dayton is the worst at bilking fines from their citizens. Most other Ohio cities are not to the level Dayton is. Regulating speed and safe roads can be accomplished in other ways without violating individual rights.

This is a shame the city of Dayton took it this far. While they may violate the home rule statute, as a city leader who supports this, they should realize all the individual rights of the motorists they violate. Regardless, it is going to be a short lived victory for them and I hope the legislature comes down even heavier handed to ban such use statewide with no exceptions.

I'm not complaining. But the tax I'm underpaying on the house is only $50-100 per year. Big deal. Jake they never do it on their own. Whenever I buy something, I always appeal the taxes because the county only adjusts them on the 3 years re-appraisal period.

^ I have done dozens of these appeals in Hamilton County as well as the surrounding counties. Generally, Hamilton county will grant the residential property owner some relief in the vast majority of cases. This does not mean the owner "wins", just the county often backs off their initial assessment some. In general I have found Hamilton County reasonable to deal with. The worst county in the area to deal with is Montgomery County as the auditor there is very aggressive in his valuations

But Jake, the revenue stream from the naming rights often increases in value over the years. Also you have to figure FC is paying a decent rental payment that will only go up if they become an MLS team. Plus, depending how the bonds are structured, there will be opportunities to re-finance into lower debt service instruments down the line to free up cash. Having your own stadium just gives you leverage.

2018 Gubernatorial Election
^ he is the only Dem with a chance at winning, but I really don't see him doing it when push comes to shove. He has a much more powerful position now and cant be fired very easily by Trump. If he leaves, Trump can then gut his agency a lot easier. I just don't see the incentives for him leaving now. He can run in 2022 and still be strong.

But of course you do know that the moon landing was staged in a Hollywood studio and therefore is not worth celebrating. :) Also, we don't celebrate the moon landing because the moon is weak sauce. When we do something truly impressive like having man walk on the sun, then maybe we will celebrate that.

^ ha ha ha ha ha, very comical (Says MLS commissioner Garber about lowering the franchise fee to pay for stadiums). In all seriousness, if this were Miami or Los Angeles or New York or San Fran, then yes because they are the right media markets that the MLS absolutely wants. In Cincinnati, no. It has to be perfect. Cincinnati will get an MLS team because it is too appealing to say no too and they have their ducks in a row to be the most deserving. We are not really a market MLS wants to have but since we prove the most viable at this time, they will take our money, if we have all the details taken care of.

^ It fascinates me how there are homeless advocates (Josh Spring, cough cough) who vigorously campaign and fight gentrification and want to keep certain neighbohoods for the poor yet at the same time complaining that the neighborhood is poor and needs investment. You cant have it both ways.
