Covington is a long way from Cincinnati, red tape wise. What do you think about SSRG/HGC? I had a good experience with them. I can warn of one contractor with a current OTR project and another nearby from personal experience, but I don't want to do it on this public forum.

He basically said "when we get the money." Of course, it will end up coming from him I suspect, but they are probably fund raising within the photo community.

The housing slump has increased that favorability. The less houses, the more rentals needed. The higher the rental rates. There is a demographic that is at risk, but that demographic is not market rate OTR.

A non conforming building right in the middle of a zone with specific and different rules. In practice, most variances are examples of spot zoning. The interesting question is who can grant a variance notwithstanding the prior ruling of a planning commission or historic board.

If the developer is backing out, he would negotiate with OTR ADOPT and file an agreed entry of dismissal as the result of that negotiation. The court does not care what the litigants do if they reach an agreement.

Did OTR ADOPT do this intentionally or was its just sloppiness? You be the judge. When J. Allen ruled against OTR ADOPT she approved the Magistrate's finding that the case should be dismissed but she did not put on a separate entry dismissing the case. So, her ruling was not a "final appealable order." Nonetheless, OTR ADOPT filed a notice of appeal divesting J.. Allen of jurisdiction and the case went up on appeal. The Court of Appeals was not fooled and cut through the legal wrangling and sent it back to J. Allen to dismiss the case - costing the developer yet a few more months. Really.

Get this: this Court has determined that the Magistrate has "properly determined the factual issues and appropriately applied the law." Appellant OTR A.D.O.P.T.'s Objections to the Magistrate's Decision are OVERRULED and the Magistrate's Decision filed on April 28, 2022 is ADOPTED by this Court. After reviewing the transcript of the hearing before the Historic Conservation Board', the Court further finds that there was no indication that Danny Klingler was appearing on behalf of OTR A.D.O.P.T. Therefore, OTR A.D.O.P.T. lacks standing in the instant appeal. She was supposed to review the decision de novo. Instead she yada yada's the decision and then actually rules as the only articulated basis for the decision being Klingler not identifying himself at the hearing as acting on behalf of OTR ADOPT? She should have made specific findings from the record. I thought his appeal wouldn't stand a chance. Now I'm not so sure.

Judge Allen has given the first appealable judgment. He gets one appeal as a matter of right. This next one. Very cheap. No hearing, just oral argument for an hour and a couple of briefs they have already written once, more or less. And, it takes about 6 months.

OTR ADOPT would rather have a vacant lot than a for profit development. The problem is only with the American Rule on attorneys fees. If the loser had to pay the winner's fees as they do in most industrialized nations, these objections would never be filed unless there were substantive errors in the approvals by the HCB. Frankly, in most cases the lawyers know who is going to win and who will lose in the final act of a three act play. But a delay is often as good as a win.

Plan is to restrict auto parking on Main from Liberty to Central Parkway. Invest in boom boxes, they are coming back!

Thank you. Its clear to me that people care. My applicants comment. One of my tenants and my adult son moved from Main St on account of the nighttime chaos as mild as it was two years back. Persons who go to alcohol driven crowd scenes and are still there at the witching hour should not be surprised at the consequences, whether it is Bond Hill, The Banks, Riverfront festivals or Main St. or even some random open red cup party. I tell them, "be the first to leave and you can hear about how the evening ended from others."
