Safety as it related to the nearby train tracks was one issue and they also had issues with the way entrance doors were configured.

Just drove by and looks as though Rosie's Kitchen in Solon is permanently closed. All signage is gone and window boarded up. I don't think it lasted two years, about the same length of time the restaurant it replaced, Paco's Tacos was open at that spot. I believe both places were owned by the group which owns Burntwood Taverns which seem to thrive.

Isn't it a fact that he is either going to have to s@#t or get off the pot soon or he will lose Benesch? (not out of town as has been strangely suggested but a re up at 200 PS or another building) If that happens I am pretty sure it remains a parking lot for my lifetime.

I was watching the most recent CH council meeting on line and their was some cryptic discussion about this Herrick Mews project across from the Buckingham (which I personally hate as it looks cheap and I would prefer a more adult, upscale project at this location). A couple of council persons vaguely spoke about some communications they were getting from people and they wanted to some how investigate more. It was never clear what type of impute they were getting but it seemed as though it might have been very negative. It may be an incorrect impression on my part but it seemed as if council was a bit clueless regarding this project which seems strange since it has been in planning for some time and has even gone through design review (where I believe it was approve but the response of the panel was very lukewarm).

Thanks for the tidbit. They really do good work. And not to get crazy off topic but that google street view pic from your post shows 4 different types of street lights within 60 feet of one another. This drives me crazy.

The building is huge. Maybe they can month ball that section where the hotel was suppose to go and pursue it when better times come. Also dividing the project into phases might help the finances if they are indeed having issues. This would be a "phase 2" I would not have a problem with since it would be virtually hidden, unlike your usual depressing phase 2 empty lot next door a project.

To answer number one. Yes, you could file a lawsuit and a good lawyer will be able to determine whether the homeowners knew of problems during the discovery process. Given your brief recap of facts I am guessing they did but this is pure speculation on my part without knowing more. Now here is the bad news. A lawsuit could easily cost you as much or more than you would recover in damages, especially if it is necessary to retain an expert (which could be possible) for any aspect of the case. It will also take a long time and you will also have devote a fair amount of your own time pursuing it. Most lawyers will charge an hourly rate for a case like this and in fact I don't even know if this falls within the type of case that would be ethical to take as a contingent fee under the Code of Professional Responsibility (but again I doubt you would find a "good" lawyer that would take it for anything other than an hourly fee as it could be time intensive.)- Canal Basin Park and Lake Link Trail

If I lived in the Buckingham what I would really be up in arms about is that cheap looking student housing they are going to build across the street. What does this guy mean "after years of uncertainly". This is probably one of the fastest moving projects in town from first announcement to shovels in the ground. The scale changed and there was that subsidy blip, but the developers always moved forward with very little hesitancy and at a pretty quick pace. Not that bummed about the lack of retail, was/am more concerned about the potential of the development in terms of quality of the design and build out, especially for such a prime site. As I said, hate to question what may be built without seeing renderings first, but the descriptions in the article as well as some of the developers comments left a bad taste in my mouth. I hate to question a development without first seeing the renderings, but from the written description I am disappointed with what may end up going up at this prime site with incredible views of downtown. Sounds like it is going to look like one of those 4-5 story wood framed rectangles that are popping up all over town. Has any work commenced on the Top of the Hill site? I am guessing no since somebody would have mentioned it but I do note that the April 6th closing of the parking lot (per the top of the hill website) was not extended as it had been previously due to various delays, so I thought maybe at least a bulldozer is moving around asphalt or something.- Lakewood: Downtown: CASTO Development
In the distant past I had a number of dealings with the head of the company and the family is "good people". My take is similar to many that they were way over their heads given their past development projects. Hmmm. I worried about these planters. They call to mind those huge ugly concrete planters that bordered Euclid Avenue for years that were never properly watered or maintained and basically blocked pedestrians. They ended up being unintended trash receptacles with leafless trees by July 4th.
