Cleveland Browns Discussion
Kinda surprised about Cribbs. I still think he can contribute something to just about any team. Maybe it was a medical issue? The other two.... I'm not surprised at all. Neither is a 3rd string project, so it was either win the backup job or get the axe.

State cuts cost local governments millions
We will see if the trickle down theory holds true. By eliminating tax burdens and making the state more 'business friendly', revenue should rise and these losses will be more than offset so services can return better than before.

Does everybody have their emergency stockpile of food and water. I heard on the radio that you can make monthly payments towards one.

Yeah.... but the lot is the same owner, right? It could just be a tactic the City is using to force the repairs. With the SB, I think the biggest issue was that the building was no longer weather tight, leaving it exposed to the elements (recall the giant hole in the roof) and causing it to deterioriate beyond the point of feasible repair. I see from the article that the building is on the national register, but does not appear to be landmarked by the City or State.

Is the Herold in nearly as bad shape as the Stanley Block was in prior to demo? Is the Herold landmarked?

^Which is why the City should continue to keep denying the demo permits and all of you who rallied so hard for saving the Columbia building should be backing the City up on this RIGHT NOW...... not down the road when the wrecking balls are on their way.

^^Yes. Kelo didn't require blight. I'm not positive on the current and specific state of the law in Ohio, but have a general idea. There are generally two aspects of 'blight' for the purpose of ED proceedings. One would be a 'blighted area'. In such cases, ED may be used if a substantial majority (approx. 75%?) of the area is properly considered blighted and individual properties can be taken regardless of their state of disrepair. Assigning 'blight' to a particular property is more difficult. To be considered 'blighted', the property must be unsafe for habitation, pose a threat to public safety, or have unpaid taxes exceeding its value IIRC. The local government must also jumpt through some additional hoops by presenting a comprehensive plan of what would be done if the property was taken. But the key factor for our discussion is that blight cannot be assigned simply because the government determines there is a better use comparatively (i.e. surface parking vs. structures) or that a different use would generate higher tax revenue.

The Ohio Constitution uses the term public USE. A public benefit may be considered in the analysis, but is not the determining factor in Ohio (although SCOTUS has ruled that public benefit alone is sufficient under the Federal Constitution). And I don't know when the ED proceedings you cited took place, but the law here in Ohio was addressed in 2006 following Kelo.... http://www.sconet.state.oh.us/rod/docs/pdf/0/2006/2006-ohio-3799.pdf..... in a case which dealt directly with the public taking of private property for the purpose of transferring it to a private entity for redevelopment. The court was constrained by the Ohio GA's reaction to Kelo. From the Norwood case: "We hold that although economic factors may be considered in determining whether private property may be appropriated, the fact that the appropriation would provide an economic benefit to the government and community, standing alone, does not satisfy the public-use requirement of Section 19, Article I of the Ohio Constitution." * * * * * In this early period, “public use” was often equated to “public benefit.” * * * * * In some jurisdictions, a belief has taken hold that general economic development is a public use * * * Kelo confirmed this view for purposes of federal constitutional analysis * * * * * In addressing the meaning of the public-use clause in Ohio’s Constitution, we are not bound to follow the United States Supreme Court’s determinations of the scope of the Public Use Clause in the federal constitution * * * and we decline to hold that the Takings Clause in Ohio’s Constitution has the sweeping breadth that the Supreme Court attributed to the United States Constitution’s Takings Clause

Cleveland Browns Discussion
I love what I'm seeing on both sides of the ball. Second straight game our 1's went up by three scores before the opposing team got any points. There aren't many teams that will 'out-physical' the Lions, but it sure looked that way last night. The defense just looks nasty and KJP is dead on with Sheard. I'm not sure how Mingo is going to win a starting job because Sheard looks to be a potential pro-bowler at OLB. A friend mentioned to me last night that the Steelers had targeted Sheard the year he was drafted envisioning him as an OLB in their 3-4 scheme. I hope they are not showing too much of T Benjamin. Teams are not going to kick to him in the regular season if he keeps flashing that "gotta get home for dinner" urgency on kick returns. I liked the separation Gordon showed on the deep routes, but was more impressed with the slant over the middle he caught which he turned into a first down by coming back a few yards to elude the tackle. That was an elite play showing elite speed. The other thing that stood out to me was the clock/game management Chud showed. Where Shurmer would have got flustered, Chud remained calm and collected and used his TO's correctly at the end of the half. Mostly a lack of holes. Keep in mind that when playing the Lions, you are facing Suh, Fairley, and Tulloch straight up the middle. Plus, while our O-line is outstanding at pass blocking, they are a mediocre run blocking unit, especially up the middle. They are all more technicians than road-graders.

^I'm starting to form the same opinion. I think it will serve a minimal benefit and be an eyesore before long (if not right at the start). I want to see less towers/poles and wires in this City, not more. I have to think there are better, more attractive ways to connect the Lakefront. I do applaud the effort and energy of its proponents.

^So would eminent domain ;)....... EDIT: actually, no it wouldn't. Eminent domain is the taking of private property for PUBLIC use. That is not what the City wants to happen here. The City wants to see the current owner sell the property to a private buyer. The Ohio Supreme Court has ruled that 'economic development' is not a public use which can justify taking a property from a private owner to give it to another owner who would make better use (i.e. more economically beneficial use) of the property. The Ohio Court was not willing to go as far as the US Supreme Court did in Kelo.

I hope everyone who pisses all over the City in the demolition threads takes note of and applaud the effort being made here. How the case plays out will be informative at the very least for future discussions.

They have to keep one. You can't depend on Lewis being your every down back should TRich gets hurt. My money is they keep BJax and place Montario on the PUP list

I agree that we have a lot of out-dated, unpreservable stock to vacate and demolish before we even begin to have a conversation about net negatives with new builds...... especially new builds in the city and not some far off pasture in the exurbs

Ohio High School Football: General News & Discussion
I consider myself an avid follower and proponent of Ohio HS Football and I didn't know that. I always thought Colerain, St. X, and Moeller were all in the City proper....... I guess because the national pubs always list them as such (as opposed to St. Edwards' designation always being Lakewood). Regardless, there is no doubt that Cleveland and Cincy are two of the best metros for HS football in the entire country. I'm not sure about the Enquirer, but the Plain Dealer's coverage area, which includes Akron, Canton, and Youngstown is ridiculously loaded.

Yes.... the 'new build' draw was hugely popular with my generation when we were in our early 20's. That's fading a bit now, but it never had to do with space. People just wanted their cheaply built, expensively decorated NEW(er) apartments which only the burbs offered.

The Ohio State University Buckeyes Football Discussion
I like the black stripe system Meyer uses. You are not officially a Buckeye until you lose the black stripe on your helmet. I believe Mike Mitchell (OLB) was the first this year to have his stripe peeled off, followed by Wilson and then by Joey Bosa (DE) and Ezekiel Elliot (RB). It's probably a good indication of who may play right away and not take a redshirt. Devon Boggard (S from Glenville) led the way last year but unfortunately got hurt before he could do much. In addition to Wilson, I have my eye on Bosa. He seems to be somewhat of a John Simon clone, plus a few inches...... I just don't know how he will find the PT given that "loaded" doesn't do justice to our depth of young talent at DE.

Not positive, but I've heard that the depth chart behind Haden goes - Owens, Skrine, McFadden, and then Wade. However, Wade is seen as more of an 'on the edge' cover man and Skrine is terrible on the outside...... so when both Skrine and Wade are in the game, you will see Skrine stay inside and Wade cover the outside recievers. I've never seen Owens play, but I know he has impressed in camp and shown some veteran savvy. That might be a good sign or it might be a terrible indictment of the rest of our depth chart. We shall see. < It's not often you get to celebrate your 10,000th post twice :-)

Wade is not a starter. He 'started' last night because Owens and McFadden were injured and they wanted to see Skrine in the nickel (where he'll likely play when everyone is healthy). On the Rams first quality drive, the front 7 were all backups, with a mix of rotational players such as Mingo, Winn, Fort, etc. Haden was not in there and Ward and Owens were held out due to injury. I also am not sure that was Wade's fault. If you want to criticize any aspect of the defensive performance last night, look no further than the safeties. Although Ward did not play, there is cause for concern that they won't be able to provide the CBs with the necessary support.
