Exactly. And that is the flaw in the UK's system (as appealing as it is at first glance) - only rich people can afford to sue. Besides, if the goal is to make people who bring frivolous suits pay the defendants' attorney fees, we already have that mechanism. If the suit is baseless in law or fact, then a judge can award attorney fees. But we already pay for the elderly and the indigent (those that present at the ER).... and our veterans.... and the disabled. All this would do is add children to that list. I mean, say what you want about some lazy, willfully unemployed adult who can't afford insurance, but no child should have to live that way. We share the costs of education by presenting a public education option to all children, both the wealthy and the poor. Why not health care? I realize it is not ideal. It is just an idea tossed out there to see if anyone would outright reject to a reform plan that carried a public "option" for all children and those already covered under currently available public options (elderly, veterans, disabled), but did not contain a public option for the rest. Of course, other details (many of which discussed in previous posts) could be negotiated in, such as electronic record keeping, tort reform, interstate commerce, etc. I think the Repubs could sell this to their constituents because of the benefit it provides to the American family

^ The restaraunt has been discussed in this thread. Try the search function. It is a French-American restaraunt I believe and its name starts with a "Z" I think. It will have an outdoor patio and bar in the alley.

+1. I like all the ideas so far as well. I wonder if a compromise can be reached so that, let's say, a program akin to medicare can be created to create coverage for children in the U.S.? So, in the end, the governement would end up paying for the elderly, the disabled and minors. All able bodied adults are on their own short of some entitlement to welfare. It would take the stress off employers and the working class so that such coverage does not have to be included in employee benefit packages and/or purchased privately. Would anybody on either side of the aisle be agreeable to that compromise if it was included in a reform plan that contained means to achieve the other goals outlined in previous posts?

It's just a massing of the buildings. They won't be just bland squares. See the Uptown Thread. But the rendering of MOCA here is design specific. I don't like it.... at least not for this corner. On the other hand, combined with the Gehry building, the new construction at the hospitals and the classics down in UC, the area will definitely be architecturally diverse.

Birth Order
Interesting stuff. My situation is not easy to peg into a whole here. I only have one biological sibling, an older sister. But I have a slightly older adopted brother who did not join our family until we were in our teens. I also have three younger step-sisters. So, technically, I am both a youngest child and a middle child.

Couldn't Jacobs have waited until the negotiations with the private property owners were done to make such an announcement, especially if it (as Gilbert claims) is illusory? This will only embolden the property owners to keep the price tag up and, in a way, justify them in taking such a stance.

AC briefs are filed in appellate courts, such as the Court of Appeals and the Ohio Supreme Court. However, if you feel your individual rights are affected or could be affected by this lawsuit, you could request to intervene in the lawsuit as an additional defendant. Sorry to milk your legal knowledge :) But would that apply to groups of defendants as well? For instance, could Stonewall Democrats or, I don't know, Cleveland Taxpayers for No More Douchebag Bigots, make a request to appear collectively as a defendant? There are two ways to intervene in a lawsuit. One is through "intervention of right", the other being "permissive intervention" You can read the procedural rule here - http://www.sconet.state.oh.us/LegalResources/Rules/civil/CivilProcedure.pdf - it is Rule 24. Although I am not sure, I would probably say the permissive intervention is the way to go because the Plaintiffs will argue that the interests at stake are already adequately protected by the City of Cleveland if a new party applied for intervention as of right. I suppose there is nothing wrong with filing applications in the alternative to each other. The fact that this is a taxpayers action also might have an effect on the ability of a private citizen or group thereof to intervene. If you are truly interested though and from a practical standpoint, I would just save resources and wait to file an AC brief once it goes up on appeal, which is where this case is surely heading.

Couldn't agree more. Everyone needs to exlore a little bit and the best time to do it is when you are young and mobile. I did. But now that I am older and have a family, I am back for good.

I want to puke. Anyone care to explain how winning this lawsuit will allow the taxpayers of Cleveland to freely live out their faith? I have done some digging on this one. The attorney (Langdon) is...... drum roll please..... a southern Ohio Attorney (Cincinnati to be exact). The suit is a taxpayers action brought by this group Cleveland Taxpayers for the Ohio Constitution and one individual plaintiff, Dorothy McGuire, both of whom have an address of 3403 Berea Road, Cleveland, Ohio 44111. Joseph Russo has been assigned as the judge. This is the guy who tried to get elected to the Ohio Supreme Court last year. Since the plaintiffs filed for a preliminary injunction, the hearing on that motion will be held shortly. It should be open to the public if anyone wants to attend. One of the requirements for an injunction pending disposition of the suit is that the PLAINTIFF will suffer some kind of individual harm that is not common to the public as a whole. I would love to hear the argument on that one.

Good read... as long as you can make it past the fragments (sorry Jeff). The idea of creating an separate entity to develop the waterfront is intriguing indeed. Sort of akin to UCI and I think we all agree that UCI, especially under Ronyane's leadership, has done wonders for University Circle's growth and development.

A big HELL NO to Bill Patmon. Patronage will reach a new high if he is elected. I also have good reason to believe that he toes the line of being a racist. Frankie J has actually grown on me. A few years back I was very vocal against him. But now, he seems to have his feet under him now and I like many of the moves he has made.

Moving to DC
This is the type of talk that just irks me. No jobs outside of the medical industry? Really? I work outside of the medical industry. So does my wife. So does my sister and her husband. So do all but one of my close friends. My brother just graduated from college and he got a job outside of the medical industry. A former employee of mine just graduated from law school and passed the bar and he got a job in the legal field in no way connected to the medical industry. I just hired somebody to work under me and my job is not in the medical industry. I would venture to guess that there are at least a few forumers on here that are employed in Cleveland and do not work in the medical industry. Let's see. World class museams. World class performing arts, including arguably the best orchestra in the world and the second largest theatre district outside of NYC. World class restaraunts. Concentrated areas of vibrant nightlife (WHD, E 4th, Coventry, Tremont, Lakewood, etc.). Three major professional sports teams. What definition of cosmopolitan are you working under? I am not trying to give you a hard time Palijandro. I realize it is a rough climate for law school grads and I feel your frustration. But that problem is in now way isolated to Cleveland, it is a nationwide issue. And it is not just a hiring freeze... young associates are being let go everywhere. Go get your feet wet in DC and I think you will find that your job prospects back here will be much better with a little experience under your belt. Cleveland actually is pretty solid in the legal field with several of the biggest and most influential law firms based here.

Well, it's not just the "action figures", they also put in a little plaza there. For now (considering we are just at the conceptual stage), I will just assume that the walkway will jet out towards Al Lerner Way in the space between the memorial and the turbine. I doubt putting a roof on the memorial is an option, no matter how ugly it is (FYI, the world-class sculptor hired to build the memorial died before the project was completed). On the issue of adding a faux waterway to the port's land, I think the more water landscaping the better. Although, I would like to see little pedestrian bridges every couple hundred yards or so.

I don't think anyone knows IF a hotel will be going in. But that does seem to make some sense as a re-use for this building. Perhaps the same hotel that wanted to go into the Ameritrust Tower across the street? Wasn't it Hotel Indigo?

No. It's proposed to link the Great Lakes Science Center with an expanded parking deck at Erieside Avenue and Al Lerner Way. It would then go over Lerner Way into a future North Coast Transportation Center over the Shoreway and the tracks north of the malls. The NCTC would, in turn, connect with the new convention center below the malls. I understand the concept, but take a look at the massings MayDay posted on the previous page. The FF Memorial is right on the corner of Al Lerner Way and Erieside Ave. The covered walkway looks like it goes right through the exact spot the memorial is located. EDIT: OK, looking at the image more closely, I see a really faint indication of "statue" with a dotted line pointing to under the covered walkway. They wouldn't really cover up that memorial, right? I mean, I know it is ugly as hell but it still is a memorial. What am I missing here?

Deconcentrating Public Housing By Forcing it in Affluent Neighborhoods...Yes/No?
You really need your own blog my man. I do not agree with the idea of centralizing or decentralizing public housing. Public housing should be strategically placed where it allows the needy an "opportunity" to pull themselves up by their own boot straps while having as little impact on "quality" neighborhoods as possible. Therefore, it should be put near public transportation and near employment centers, but not in downtown and not along TOD's. And definitely not on waterfront property!

Right now, there is a nice and very underused green space on top of that parking. It's not retail or residential, but it is "mixed use" I would leave it as is.
