There has to be a "deal" (contract) first before interference can be claimed. If the land behind TC is worth as much as FCE claims it to be and given this "connectivity" argument they keep making, it should not be hard at all for them to find an alternative, non-CC use. On another note, does anyone know how high the ceilings are at the IX center. Seems well above 30 feet. I see that the exhibit halls are well over 600,000 sq ft. I am just wondering whether the big shows like the international auto show will stay at the IX center. I was out there this past weekend and it did not seem like such a show could have fit comfortably in 300,000 sq. ft. of space as is planned for the downtown CC.

If it does come to that, it will be such an obvious case of crying over spilled milk that it's not even funny. In my opinion, as long as FCE is given a chance to present their case fully, there should be no reason for them to sue .. and if they do, it'll be such a childish, spoiled brat move on their part. Any lawsuit that they would present would only serve to hold up the process, which would be horrible for Cleveland. This project doesn't need any more delays. They would need to obtain a preliminary injunction to stall the project and, to do that, they would have to show a "high likelihood" of success on the merits. Good luck FCE. The simple filing of a lawsuit would not be enough to stop the shovels. I really doubt that FCE is that stupid. More likely, they would lure some disgruntled County resident who only cares about the bottom line ($$$) to file a taxpayer action.

OK. They love a good lawsuit Hopefully, if it comes to that, their lawyers would explain to them the term "frivolous". I can't even begin to imagine what the cause of action would be. The Osborne finding is no suprise. Like the earlier post said, MMPI would not risk the possible construction cost overruns if their study of the foundation was not solid as rock.... no pun intended ;)

In a resolution passed unanimously Monday night, the council declared the downtown mall as the "most advantageous" location for the $425 million proposal. Good to see some solidarity on this issue from council. If I had to speculate (and that's all anybody can do other than those that heard this conversation), Jackson could have been opposed to the resolution for purposes other than lobbying for FCE. For instance, such a resolution could be used to minimize the City's bargaining power on the property acquisition negotiations. Or.... they could have been talking about a whole other matter.

World War II discussion
I don't have the source to confirm this, but I am fairly certain that the Japanese suffered more casualties during the fly-over bombing campaign of Tokyo in 1945 than it did with the bombings of Hiroshima and Nagasaki. I am pretty sure that one day of non-atomic bombing caused 100,000 deaths. Just saying that the Japanese had plenty of incentive to surrender sans the use of nuclear weapons. Admittedly, whether they actually would have without us using the nukes is pure speculation.

No guns for me. I've got my manos de piedra. :wink: I've got a friend who has a C&C and somehow I feel less safe when I am with him. Go figure.

This should seal the deal for Ferry as Executive of the Year. His patience has continually paid off. No risk to the defensive or offensive end of the court with this move. No risk to chemistry. Joe coming back can do nothing but help our title hopes. I think he starts until Ben comes back and then we can get back into that Z/Ben and AV/Smith rotational balance, affording Coach Brown the luxury of keeping one big man with range on the court at all times. http://www.cleveland.com/cavs/...e_smith_lo.html ATLANTA -- It appears the Cavaliers are going to get some quality big man help for the playoffs. With just hours to spare before Sunday's midnight deadline, the Oklahoma City Thunder and Joe Smith reached terms on a buyout agreement. He will be put on waivers Monday morning and is expected to clear them 48 hours later. Several league sources said Smith is then expected to sign with the Cavs for the rest of the season. I believe the price of concrete has a much more dramatic effect on price tag for the TC site due to the re-use of the existing foundation at the mall site. I agree with the earlier stated concern that this could turn into a "who can build it the cheapest" contest and quality of the product would be lost in the shuffle. I wonder what was planned for those two floors that are now being discarded. Actually, I guess you would have to ask what was planned for three of the floors that are not part of the new plans considering that the MM would now occupy one of the floors that remains in the plans. Doesn't sound like a "first-class" facility to me. Didn't MMPI state that they want the MM in a separate building?

A kid was shot just up the street from me in South Euclid the other month. I don't feel unsafe. These things happen, especially in the age where guns are so glorified, and its tragic. I think if you did some research on the murders in the City of Cleveland, you would find a very miniscule percentage occuring downtown. I continue to walk the streets of downtown with security. On the issue of what punishment should be given to these thugs, I would throw the book at them but have to admit do not agree with the death penalty on principle. There are several types of murder (listed in descending order of seriousness): 1) Pre-meditated - meaning it was thought out and planned 2) Felony murder - meaning somebody died during the commission of a felony, regardless of who killed the vicitim or how he/she died... the perpetrator of the felony is liable for the death 3) Voluntary manslaughter - occurs in the heat of passion (such as a husband killing a cheating spouse in a fit of rage) 4) Involuntary manslaughter - oops... I ran you over with my car. All the criminals here are guilty of either (1) or (2). If it was planned to kill the victims before the commission of the crime, then all 5 are guilty of pre-meditated murder. If just one of the thugs lost it during the robbery and killed the two victims, the trigger man is guilty of (1) and his cohorts would be guilty of (2) regardless if killing the victims was part of the plan. Now, which one of those above listed examples most resembles the State of Ohio carrying out an execution on a pre-arranged date and time. On the other hand, think of the "A Time to Kill" situation where a father kills his daughters' rapists and decide which category that act falls under. Not saying that I support vigilante justice, but isn't it ironic that the former is legal (and often encouraged) but the latter is illegal?

If council won't initiate the negotiations, what the law requires is the signatures of 25% of the electors who voted in the last election. A grassroots movement could get that done. For better or worse, EC has the most "street activity" on the east side. Gathering sufficient signatures would not be that difficult IMO. At the very least, it would become instant front page material and the public debate and pressure would rise from its present ashes (if there ever was any fire to it). However, I am not sure what kind of effect it would have. I have doubts about the UC neighborhood heading that way before it swallows up Hough and heads towards 55th. Best we could probably hope for is that Euclid to Superior would become more desirable and the building stock on that strip can/will be preserved. I say "can" because I suspect at least some of that stock has already reached the point of no return in terms of repair and re-use. Forrest Hills would be a real nice addition for the City.

Anybody had ACL reconstruction/ortho surgery?
I ripped up my knee twice in college playing football. Same injury both times. Not the ACL though, I tore the MCL and patella ligament. All I can say, and take it from a guy who made this mistake the first time around and paid for it with the same injury the next year, is REHAB, REHAB, REHAB. Don't do it yourself... go to the PT and do it right. It is your only chance of your knee ever returning to full strength and stability. 20 years ago, there was little hope to restore a torn ACL. Nowadays, full recovery can be achieved, but only with a significant commitment on your part.

Does anyone know what the use the Clinic is employing for that large factory/WH on the corner of Euclid and London in Collinwood? I drive by it quite frequently on my way to the inbound east shoreway but, always approaching from the east, I never noticed that there was a Cleveland Clinic sign on the western side of the building. That complex is massive. Storage perhaps?

The procedure is governed by Ch. 709 of the Revised Code. In a nutshell, the basic procedure would be as follows: 1) Either EC's council proposes annexation through an ordinance declaring its desire to be annexed or the electors of EC pass a petition (25% of voters) directing the council to take such action. 2) 3 commisssioners are appointed by council, or the probate court if council can't agree, to negotiate the terms of the annexation - such as whether it will be for corporate municipal purposes or just for schools. Cleveland would take part in these negotiations of course. 3) the negotiated conditions of annexation are submitted for a vote of electors of both EC and Cleveland at the next regular or primary election. Although, Cleveland's city council may assent to the annexation and waive the vote of its electors on this issue. The EC electors must vote. If approved, the annexation occurs.

The site selection will become final once MMPI's engineering study re the old foundation is confirmed. Until then, FCE and Wolstein (and the PD) can hold out hope.

Of course the actions of the inhabitants necessitates the police presence. Go to any economically depraved neighborhood in the country and crime will be a problem. But in EC there is no deterrent. Drive around Cleveland Heights, and I bet you can't make it 5 minutes without seeing a cop. In EC, that is not the case. There always has been a problem with minimum manning in EC, especially for the ECPD. One of my best friend's dad just retired from ECPD and he always complained that the police simply did not have enough of a street presence to make any impact. They are too busy responding to calls, that they cannot effectively deter crime before it happens. Look at what Rudy G. did in NYC with his order-maintenance policing. He took cops out of their cruisers and put them on street patrol going after the criminal element, perpetrators of vandalism and aggressive panhandlers. Putting aside the constitutional issues that such measures invoked, the aggressive, street-beat cops were largely successful in cleaning up the streets of Manhattan.

The problem in East Cleveland is and always has been (as far back as I can remember) police presence.... or, better put, an utter lack thereof. Until an investment is made in putting black and whites on the street corners, EC will not garner any investment from the developers that (all things being even) would probably love to get their hands on some of those beauts on Euclid Ave. Sure, the abandoned houses are an eyesore, but the public's safety is a much bigger problem. This City should be thriving right now due to the Euclid Corridor and its proximity to UC. The only solution I see is annexation but am not sure Cleveland would even agree to that.

Don't get me wrong, it's got some great attributes. I just don't like those attributes in Fort Mill. This is not Cincinatti where building over the state line is within one urban fabric. It is not even like building this type of development in the Heights or Lakewood areas of Cleveland. This cannot be called "inner-ring". It is sprawl.

It would never happen, but a park with some unique attributes would be nice. I live not far from there and really don't think that intersection can handle any more retail. My most "realistic" hope is for housing, but unfortunately I see one of those Beachwood office parks that has really hurt the downtown office market in the past couple decades.

For an urban neighborhood in an urban setting, I would wholeheartedly agree with the small setback argument. Put this development on 7th street and I love it. Put it in Fort Mill, SC and I don't care for it. This is not urban. It's about as ubran as the golf-course community where my friend's parents bought in Cary, NC. Their house is connected to the next and they have a very small setback. Doesn't make it urban. Those features have much more to do with making the developer as much $$ as possible than creating an urban atmosphere.

Agreed 100%. I'm not against the uses presented here, but lets have a little more of a vision for how to get the most out of our Downtown Lakefront, instead of a 1 story stripmall, a concert venue, and a surface parking lot disguised as a plaza. IMO, it makes a lot of sense to put an aquarium on the lakefront so the lake can be incorporated into some of the exhibits. I love the idea of developing this parcel, but am not a fan of the renderings/proposals I have seen. To be clear, I am not totally against the idea. I like the fact that it would have a natural connection to the RRHOF.

I don't care for him, but he is not nearly the weasel that Eric Cantor is. I do feel that he actually wants the stimulus bill to utterly fail. At this point, many Republicans are more worried about their party's image than the economy. They would love nothing more than for this country to fall in the toilet so they can say "told you so". Wait.... Bush already put us there.
