July 27, 20213 yr On the news they were talking about how the Pizzuti rep "claims" that the new development would result in less traffic than the Giant Eagle. It's pretty easy to prove that a supermarket leads to way more trips than residential. Isn't the rule of thumb something like 2 trips per person per day? Assuming 2.5 persons per unit times 262 times 2 trips that is 1310 trips per day. That's nothing to a supermarket. Couldn't even stay open considering in is one trip and out is another. Just the employees are 300 trips.

The one lawyer that was against was claiming that during the variance application process for this project, they somehow violated some Ohio Supreme Court decision. July 27, 20213 yr I'd be surprised to see an Ohio Supreme Court decision that says that the controlling entity over zoning doesn't also have the right to grant variances. If there is, it's probably going to be some miniscule technicality but if the law creates the zoning board and outlines the appeals and zoning variance process and that was followed, it's hard for me to believe anything could be floating out there that hasn't been tried before. A cursory search seems to show the Ohio Supreme Court generally ruling in favor of zoning variances even overturning the Cleveland Zoning Authority for one they denied as recently as last year. It seems the Supreme Court deemed the Zoning Authority's arguments for denying were too weak and disproportionately applied. A Some creative folks may try to quote the taking clause but the burden of proof would be so significant I can't see any judge entertaining it.

Whittier St. The project had already received support from the South Side Area Commission and the Development Commission, which normally would all but assure a positive vote from council. The church and school want to move the historic church rectory residence 75 feet west closer to 3rd Street. The rectory move would open up space in the middle of their school campus to install an outdoor playground for students and to build an addition to the existing Saint Mary School building. August 9, 20213 yr I have no problem with this, but is there some reason they cannot make an addition to the front of the school? Do they need it to be so far back and have that empty grassy front lot that is of no use whatsoever? They can't enclose that and make some kind of use out of it such as making part of it a recess and playground area? So many front lawns serve no purpose whatsoever-especially in that area where many homes have little if any front yard at all. Look how close the other buildings(including the church)are to the street.

Their arrival into a local environment is usually a precursor to whales joining the environment in the near future. They have a sort of symbiotic relationship where these scavengers will devour the remains of dead organisms and clear the space for the whale to move into it's new habitat.
