Obviously, we don't know each other.   So sorry that you have experienced this negative outcome.  I don't know how definitive the language from the leasing agent in the emails is regarding their promise of the Murphy bed option.  If it is definitive, go for it.  However, if the leasing company has a legal out they will surely take it.   

 

But perhaps my advice is to consider this alternative and ask your attorney negotiate - for example - a $250 reduction per month for remainder of the lease.   For that amount of money, you can probably purchase some nice IKEA compact bed or futon and carry with you to your future and better apartment.   

 

Life seems too short to get wrapped up in so much time and emotion.    There might be a silver lining here somewhere including positive acceptance that carries into other unexpected areas of your life.    Perhaps, you might meet your future partner on the trip to IKEA in Columbus.   I'm totally BS'ing it here but I think you know I am trying to be supportive.

Ah copy then a judge would probably send both parties back to the negotiation table to figure out an amenable solution.

If it was a piece of furniture, I'd say kick dust. With that being a fixture, its considered real property and part of the condo. Now, they can put a disclaimer on renderings saying they may not match final results, but you can only get away with so much (i.e. you can't just remove half a kitchen). Furthermore, if its AT ALL denoted in the floorplan of the marketing material, it's almost a given it'll be in the unit.

Thank you for the kind words, but I just can't let this go. They will not win a war of attrition with me. Too often the little guy gets screwed because they have too much going on in life and can't spare the time or energy. Often it's the poor who don't have the resources or know how. Once in a while, someone needs to push back. 

 

The language is definitive in the emails. 

 

I waited until mediation, but I'm very close to start destroying them on Google reviews, Better Business Bureau.

I have no idea. That would be nice, but then I'd have to move again. Moving is such a nightmare. If they would have told me before I moved in they would not be following through on their commitment I could have made a more informed decision.

It says "optional", but the emails clear that up.

But if in the same building it wouldn't be the end of the world.   And you get an upgrade at the same rate as the studio?

This is true. If it was offered, I might take it. All they have offered is $150 off rent.

Plus, make them pay for the intra-building move. Packing and moving!

 

Propose a fix, and be clear that if they don't, you're happy to take them to court, not to mention that you'll broadcast their lies on social media, the BBB, etc.

Yeah if you have documentation proving you requested that option, and they listed it as an option, then it's absurd if they didn't include it. That being said, I've never seen apartments have "options" - typically that's a condo thing.

I just left a scathing review on Google Maps. It was very cathartic. I'm so curious to see their response, considering I have the truth on my side. I brought their star rating down from 4.1 to 4.0. Here's to hoping somebody brings them down below 4.0.

And my lawyer says to go the small claims court route. So I'll do that for the max of $6,000. I'll let you know how that goes.

Are there any positives? Like, how does the lobby look? Is the coffee bar running yet? Is Dogtopia getting good business I hope?

And what a shame about no progress on the restaurant. What about the speakeasy?

You totally dodged a bullet. I really regret it. The only positives are the people are really cool that work there. The lobby looks mostly complete. It's nice. I think Dogtopia if getting business too. 

 

The coffee bar is not even built yet. No progress on the speakeasy either. The tvs aren't working in the clubhouse. The theater room is locked with no TV because they didn't hire 24 security to stop a homeless dude from getting in and breaking it.

 

Just embarrassing. Any bad review is more than deserved. Thank you for leaving a review. 

Not making excuses, but could some of the problems be result of new owners and a new management team, stepping in recently, and at the last minute. Probably the worst time, trying to wrap up construction and gearing up leasing.

I would give them the benefit of the doubt about delays if they didn't repeatedly tell tenants everything would be open by May of 2024, and now it might not be open by May of 2025. Just be upfront and honest man. I get it if things go wrong. Just don't give people false promises to sucker them into leases.

 

And the Murphy bed situation is something else entirely. No excuses at all for that. That's low life bait and switch.

Skyline's response on the Google Maps review was a joke. It was essentially a stock response that I had not reached out to management prior to writing the review. So I edited my review to respond to their response. 

 

Also, I officially filed a small claims case against them yesterday. I'll keep everyone posted.

 

Still no working tv's in the clubhouse. No tv in the theater room. No coffee bar, wine bar, and the speakeasy and restaurant are not close.

I'll never understand how a corporation can invest millions and millions into a project and then drop the ball on the last few thousands. What's that old saying, Penny wise, Pound foolish?

I got one too on my review. Idiots. But this project will sink - the property manager can make or break a place, and they're definitely breaking it.

Anyone know if the rooftop space is open. It seems to be lit up  Also in this same photo wouldn't it be nice to hear some talk again about 750 Huron. Surprised it's taken this long. Remove those antennas, unblock the windows, turn some lights on. It's 2025 most of that equipment is probably obsolete.

The interior of the rooftop space is open. It's still not completely finished. The exterior part of the rooftop is not close to complete, such as the pool and cabana area. 

 

A big draw of the rooftop space was that there were plans for the French restaurant to staff the rooftop with a bartender on weekends. The French restaurant is not close to being finished and there is no bartender upstairs. It sits mostly unused as the TV's aren't even operating up there.

 

The way the previous and current management upholds their promises, I will be shocked if the rooftop ever gets staffed by a bartender on weekends. Please prove me wrong. 

 

The building doesn't even have nighttime security. Hopefully another homeless person doesn't access the building again and damage another TV in the theater room, which still hasn't been replaced.

An amazing building, with amazing potential at an amazing location ruined by sh*tty management. 

I'm sorry for all the people getting disappointed from this development. My question(s) for the people that took a chance on this development, do the bones seem good? If the finishing touches are completed and the building is transferred to new management, will it live up to its initial hype? Or do the problems run deeper than that? Or was it just oversold from the get go?

I don't know anything about architecture so I can't speak on the bones from a structural standpoint, but the parts that are complete look very nice. The lobby is very unique and colorful. Miami vibes.

 

The building WAS transferred to new management and nothing has changed. It's the new management that refuses to live up to the written agreement I had for the Murphy bed. 

 

The small claims court hearing is on the 29th.

 

I have to say someone from ownership called me against their lawyer's advice and was very polite. He seemed sincere. But that's not meaningful when he offered me literally nothing that was a value add for me.

I have nothing. It looks like they're putting stuff on the rooftop, not necessarily signage. But I don't know.

Also, their review scores on Google are back up because they got like 4 or so 5 star reviews back to back within the span of an hour or two. Obviously a concerted effort by management. ^ That is interesting because we were driving past it last night on the way to Playhouse Square and it looked awfully dark, like only a few units had lights on. And man, the Centennial corner was really, really dark. Those pics of it lite up by that very classy lighting Millennium had planned sure would have been nice. Too bad.

I don't believe those numbers. I have nothing to go on empirically, but I'll bet 89 percent isn't accurate. I rarely see people in the building.

I had the small claims case Wednesday. No ruling yet. Their lawyer was beyond annoying and frankly his logic for the value of the murphy bed was nonsensical. He even let it be known he was a "math minor" in college. What a self aggrandizing blowhard.

Was the blowhard only arguing damages or was he contending that there was no breach of contract in the first place and as such no liability?

Well if you go back to court just let me know.  I was a math major which I am sure is super relevant to your case.

The lawyer listed off 18 different things that are required by law to be included, such as heat, running water, etc. Then he tried to argue that each of those items is worth my rent ($1,275) divided by 18. The murphy bed was not included in the lease, so if it had been it would valued at $1,275 divided by 19. That's $67 a month.

 

I immediately said that is a preposterous calculation that no reasonable person would accept. Like if my apartment didn't have heat, the value would drop by only $67 a month? I said if any one of those mandated line items is not included, the value of the apartment to any person in the real world would drop to near zero, not by $67. 

 

It was at that point he threw out the math minor line. What a joke. 

 

The point being, he was trying to trick the judge into essentially saying "he's got everything required by law, and all of those add up to the price of rent, so the murphy bed must be worth even less than those individual line items".

 

He honestly seemed to not understand my logic. I'm dumbfounded how a seemingly intelligent man could honestly believe his own logic. He should have studied more economics and less math.

I noticed I never answered your question. He definitely stressed it was not in the lease, which it wasn't. I countered with the fact that there is no toilet in the lease and no sexy bathroom in the lease, but they honored everything else about the floor plan except the murphy bed, including a rolling table that is of much smaller value than a murphy bed. 

 

He also argued the value of the murphy bed, which is about $3k more than what I asked for in damages.

I have been really biting my tongue about this. I see leasing agents bring people in to show off the apartment. I say nothing. If I lose this case I will make it a point to approach all of them and tell them not to rent here. 

 

It's too bad. I was so so so excited to live here.

 

I did notice some sort of work being done on the roof in the last week or so. Hopefully they will actually have the pool area done by summer, albeit a year later than was promised.

They put construction scaffolding sidewalk protection along the front of the building. Must’ve got the top panels in.

It is NOT looking good. The panels installed on the western side are clearly a simple gray with no pattern. 🤬🤬🤬

From this old KJP article, looks like the top of the east side should have been patterned; not sure about the west, but why would it be different?

Could they get in trouble with Planning Commission if they do this?  Deviating from the approved design without further approval.
