You all may have heard me for a very long time talk about how I have a tiny 400 square foot unit where a murphy bed was going to be installed with it. Time and time again I was promised a murphy bed. I have since moved in and was told even after move in a murphy bed was on the way. Now they say there will be no murphy bed. This was THE reason I chose to live in the building with rents at over $3 per square foot. It made it affordable for me. Now it's not happening. It's even in writing via an email. It's just not in the lease because I trusted them. What makes it worse is TO THIS DAY they advertise a very specific 7 foot sofa chaise lounge murhpy bed with built in shelving. That's a $7K item when installed. I know this is off topic, but if anyone has any advice for me please let me know in DMs. And please do not rent from these people. There is an open house on Friday night. I'm going to attend and have a word with prospective tenants.

Among the things we discussed were the exterior panels near the top of the building. He said it was due to a supplier issue and that we probably won't see the remaining panels installed for at least a month. The IKEA-grade kitchens confirm that. Looks like a European nightmare

You should be entitled to a rent reimbursement since the day you moved in and an ability to cancel the lease without penalty. I would raise hell. Sorry that happened to you - good luck. Sorry that happened to you - good luck. Thank you for the kind words. They have offered to cancel my lease without penalty and $150 off per month for the next 9 months, but that's it. It's not CLOSE to the value of what I signed up for. No offer for rent reimbursement since I moved in. Thing is, I don't want to cancel my lease. I just moved all my stuff in. Moving is a nightmare. Just make it right and do what you promised. Good God, how hard is that? These people. Don't know if I have a legal case, even with a written agreement via email, but I'm heading to the Justice Center tomorrow to put rent in escrow until there's a hearing. I will keep everybody posted. Also, looks like Dogtopia is open. I see employees in there.

With the sidewalks open and how they staged the metal panels on them it will be interesting to see the process continue. Does anyone know the status for install to start again? Did the building's sale include the building's completion?

I don't know if they have the colored panels for the penthouse floors yet but they have been installing the regular panels on lower floors. It'll be great to see this completely finished.

I'm no construction materials expert, but doesn't that orange/yellow siding material have a fairly short time span where it can be exposed to the sunlight/elements before it starts to degrade?

The employees that are there are truly great people, but the management company still sucks. They still don't have 24 security. And I have email correspondence from the leasing agent speaking about the murphy bed. I have no idea if I have a case, but I'm definitely moving forward with this. I will keep everyone updated. You have the e-mails, so you have it in writing. I would also download or capture the webpage showing the murphy bed. At the very least, it is false advertising. What a terrible way for the management company to get off on the wrong foot with the tenants. I'm no lawyer, but what is right is generally what a reasonable person would ascertain based on the information provided.

I'm not a lawyer, but have had some experiences of my own with issues like this. If you try to break the lease and they hold you to it, you can sue them under the Ohio consumer practices laws--since they are advertising the murphy beds on the website.

They have offered to allow me to break the lease and have also offered $150 off rent per month for the remainder of the lease. To me, that's entirely unacceptable. Breaking the lease after having moved in is such a pain. The cost, time, and headache of moving, ugh. And the type of sofa / murphy bed they are advertising on their website is around $8K with installation costs. It's not like this is some budget item. My lawyer says he's not sure the judge is going to force them to put in the sofa / murphy bed, but he mentioned taking them to small claims for breach of contract, which is a $6K max award. At this point it's about the principle of not screwing over the little guy, so I will go through with it. By the way, the leasing agent who I had been working with from the beginning left the company. He said they were an absolute nightmare to work for. Go figure.
