November 29, 20186 yr Cranley, Dennard and Young are 3 different issues. When Cranley dropped his in a hot tub, his texts were not under scrutiny and he was not subject to an order to preserve the texts. That is a big difference right there. Dennard, was subject to the order to preserve the texts and was negligent in her preservation of them by dropping her phone in the pool or hot tub. Legally, in the grand scheme of things, she likely gets a pass as long as there is no proof that she dropped in the pool purposefully. IT comes down to that for her and, I don't really see how to prove that. Young is the one in trouble because after being told he is subject to the order, he willfully deleted the texts on his own. Dennard may have egg on her face but no legal trouble, but Young could be in trouble for opening defying a court order.

What I'm hearing is they were obviously NOT using the "common colloquialism" in a literal way, at which point one might wonder whether it was being used at all, and if so in what sense. It's really all up to interpretation at that point, and a literal reading of their language creates a very bad look. It's up to prosecutors and the courts to determine whether their "hyperbole" is prosecutable or criminal, just as the severity and criminality of the councilmembers' actions are up to the same.

I'd counter by saying that there are several successful CPS schools, and although most receive failing grades from the state, many folks simply can't afford to relocate or pay for private schools (though there's a greater societal question about the responsibility of choosing to have a child when you can't afford to raise it - but I'm not going to derail this discussion with that one). Labeling innocuous statements like these as "racist" really just alienates average and apolitical folks, and worse - it downplays actual racism in a "boy who cried wolf" manner.

There are many other messaging platforms that offer end-to-end encryption like Signal and iMessage. Email is also completely insecure and should not ever be used for sending anything sensitive.

June 12, 20205 yr I think all the COAST boys live in the Cincinnati suburbs, except for Mark Miller. Since he lives in city limits, he always serves as the plaintiff of these cases when they sue the City of Cincinnati. Since their guy got elected mayor, they have largely stopped suing the City of Cincinnati (except for the "gang of 5" stuff) and have moved on to suing the county and state. I believe that have also worked with other conservative groups to get things like red light camera bans passed in other cities.

Some thoughts in both directions here: (1) Many complaints can read like they're trolling to those of different allegiances, especially civil rights or consumer rights complaints. That said, it's bad writing. The acts should tell the story, not the rhetoric, when there is a story to be told. (Some complaints are obviously much more dry and clinical, e.g., a standard collection or foreclosure complaint.) (2) I don't understand naming Dr. Acton in her personal capacity. I think the judge will likely ask about that. My guess it has something to do with the request for damages, in some sense like suits against police officers in their personal capacities, but this is emphatically not my area of the law. Regardless, I'm sure she is both indemnified by the state and the state will handle her defense. (3) I don't understand the carping about Neil Ferguson and other allegations that are essentially irrelevant to her power. I'm being somewhat charitable to their argument here, but I'm going to assume (for lack of anything else to glom onto) that this is part of arguing that Dr. Acton's orders were "arbitrary and capricious" under administrative law, assuming state administrative law is the same as federal administrative law (but I don't really know that, because the "arbitrary and capricious" standard for setting aside federal agency action arises from the federal Administrative Procedures Act, and I have literally zero idea if Ohio has an analogous statute or judicially constructed rule). This would be a separate and independent line of attack on the stay-at-home order, separate from the issue of whether applicable state statute gives her the power in the first place. Assuming the same standard applies, it's the difference between having constitutions and statutes for what powers regulators have at all and also statutory or judicial rules on how those powers can be used. I'm obviously skeptical of the latter issue. I can think of multiple counterarguments and a lot of the complaint reads like just Facebook-style venting. But I might have said similar things about the complaint regarding northeast Ohio gyms, and they found a judge willing to buy into that one.
