Posted February 15, 200619 yr Judge: OSU erred in firing hoops coach O'Brien Business First of Columbus - 2:09 PM EST Wednesday Former Ohio State University men's basketball coach Jim O'Brien won round one in his fight over being fired by the university nearly two years ago. Ohio Court of Claims Judge Joseph Clark ruled Wednesday that O'Brien didn't commit a breach of trust sufficient enough to justify his dismissal in June 2004. The court will hold a hearing to determine the damages O'Brien is entitled to collect from OSU. No date has been set for that hearing. O'Brien filed a $9.5 million lawsuit against Ohio State in November 2004, claiming his dismissal was illegal under terms of his coaching contract. Former OSU Athletics Director Andy Geiger dismissed O'Brien, claiming he violated his contract by giving a $6,000 loan in 1998 to the family of Buckeyes basketball recruit Aleksander Radojevic. Geiger acted after being informed of the loan in spring 2004. Clark ruled O'Brien breached his OSU contract by making the loan, but that wasn't enough on its own to warrant his firing. The judge said Geiger failed or refused to work with O'Brien on resolving the issue and he didn't give the coach an chance to discuss the issue with his attorney before he was fired. February 16, 200619 yr Judge: Ohio State improperly fired ex-coach O'Brien Wednesday, February 15, 2006 COLUMBUS, Ohio -- Ohio State, awaiting a decision on possible penalties for NCAA rules violations under former basketball coach Jim O'Brien, could have to pay him millions of dollars for firing him under a judge's ruling Wednesday. O'Brien claimed the university improperly fired him in June 2004 for loaning $6,000 of his own money to a recruit. Ohio Court of Claims Judge Joseph T. Clark ruled O'Brien broke his contract by giving the loan and failing to inform university officials, but the error was not serious enough to warrant firing. The university violated the contract by firing him without compensation, the ruling said. The 55-year-old O'Brien sued for $3.5 million in lost wages and benefits. The award, which could reach nearly $9.5 million with interest and other damages, will be determined after another hearing. The NCAA is expected to decide within the next few weeks whether to penalize the school for violations committed during O'Brien's tenure, including gifts of cash, housing and other benefits to players. August 3, 200618 yr Good for O'Brien. I felt the school had not treated him properly when he was fired. Thankfully, the Andy Geiger era is over, and hopefully so is this type of press... for at least a while.
August 3, 200618 yr Oh please. He cheated and he should be fired! In fact, he's not debating over whether or not he should have been fired. This trial only addresses that his contract states that he cannot be fired *without pay* for cheating. The only thing Andy Geiger did wrong is give him that rediculous contract in the first place. I love that he's saying things like, "I'm doing this to clear my name". You didn't clear your name! You still cheated! Now you are just going to get paid for the remainder of that extremely lucrative contract you signed.
August 3, 200618 yr Have you any idea how much of this stuff goes on in college sports? The only reason they did this to O'Brien is because the team wasn't doing well and they wanted a cheap way to eliminate him.
August 3, 200618 yr So did Geiger turn him in to the NCAA? That seems strange that they would set the program back at least 4 years just to get rid of a coach with 2 years left on his contract. Aren't they banned from the big dance this year because of this mess? How do you think that looks to high school recruits.
August 3, 200618 yr OSU put a self-imposed penalty on itself for what had happened. They opted out of the tourney for 1 year. I don't believe the NCAA is imposing any additional sanctions. I think that was viewed as worth it to OSU in exchange for getting rid of O'Brien for free.

I don't think that Oden will be able to control the game as much against a team that is as big/powerful as Georgetown. The Hoyas present a lot of problems for the Buckeyes...it will be an interesting game to watch. My championship matchup: Florida v. Georgetown Florida is playing very spirited basketball right now...they look very tough for UCLA to handle.
