Only five minutes after yesterday's Blower predicted a high-profile local politico was about to get his philandering ass sued for sexual harassment, Hamilton County's pants-dropping prosecutor called a press conference. Coincidence? We think not. So today, in keeping with our policy of naming the accuser while respecting the privacy of the accused, we're bringing you the top ten lines overheard when "Merciful Mike" Allen finally did his long-overdue Jimmy Swaggart impersonation:

REMOVAL FROM OFFICE

FOR CAUSE SHOWN

 

Regrettably, the recent actions of Michael K. Allen and his inability to see beyond his own ego as to the necessity to resign, I take the following actions in order to spare the community unreasonable delay in fulfilling the public outcry for his inevitable removal. As required per ORC 309.05, this complaint is filed and signed by at least one taxpayer, requesting that Michael K. Allen, Hamilton County Prosecutor be removed from office due to "wanton and willful neglect of duty" and "gross misconduct in office." and the office declared vacant.

 

UNDISPUTED FACTS

 

1) Allen has admitted engaging in a four year affair with a subordinate in the Prosecutor's Office in plain and serious violation of the policies and procedures of his own office and that of the County, regardless of being consensual or not. His continued actions can only be characterized as gross misconduct in office with an indifference and arrogance that offends the moral standards of the community he has sworn an oath to uphold as much as they offend the legal standards of the county.

 

2) Allen, through his attorney, admits that when served with notice of a Civil Rights Complaint - he (and other senior staff members) again, violated, not negligently but knowingly, such policy and law for his own personal benefit and without regard for the legal and financial liabilities his actions posed to the community. Independent actions of Allen, privately and publicly, constitute an interference in government operations and a misuse of confidential govemrnent records, thereby illegal and unethical.

 

3) Allen's failure to notify the Board of an eminent lawsuit in which the Board may be involved represent willful and wanton neglect of duty.

 

4) Allen's unauthorized hiring of private legal counsel to negotiate in a suit that he knew or should have known involved the County represent an abuse of his authority and an intention to cover-up the incidence of complaint against him.

 

In the event the Court does not find that such aforementioned, undisputed actions are not sufficient alone to order the removal of Michael K. Allen as Hamilton County Prosecutor and to declare such office vacant, I ask the court to set for hearing on those aforementioned issues and the alleged

 

5) violation of the Civil Rights Act, sexual harassment, by Allen.

 

Furthermore, the Plaintiff requests that upon granting such order for removal, that

 

1) the Court order the Board of Commissioners to fulfill their duty in immediately naming an acting-prosecutor if and until the Republican Party presents and qualifies an appointee prior to the election of a successor.

 

2) the Court order the Board of Elections to prepare a special election and or ballot, either separately or in conjunction with the general election, providing the names of persons from each of the major representative parties of the county, and others meeting criterion established by the court and within a specified time frame, who wish to serve as an elected Prosecutor for Hamilton County in order to bring forth a duly elected prosecutor.

 

DISCUSSION

 

The provisisions of ORC 3.09 "Appeal in removal cases; election to fill vacancy" describe the legal due processes for a person removed from office, reflect the complexities and poor timing of these specific circumstances and adequately provides for a means to permit the citizens to make a fair and true selection of the next County Prosecutor. Because legislators could not have fathomed that an unopposed elected official would be removed from office so close to a general election, that the due process requirements would dispel the ability to meet such provisions in every circumstance, and that the ORC 305.02 "Filling vacancy in county aces" could result in the appointment or election of the very person deemed necessary to remove or unjustly favoring one party over another, invalidatirg our system of checks and balances provided in the authority of judicial power and open elections - it is necessary for the court to order a special election or order other such provisions that will allow a See, equal and unencumbered election of persons interested and qualified to secure the intent of legislators on behalf of the public,

I hadn't thought of this, but The Whistleblower today rasied an interesting and valid point about how the Mike Allen scandal could effect the presidential election:

^I thought of that. It wouldn't displease me if it made people rethink their automatic votes for Republicans who are not the saints they like to portray themselves as in many cases. I do worry that the Hamilton County Prosecutor's office is going to be negatively affected by all this turmoil. That is one point about which I would agree with Phil Heimlich. If Allen had half the class of New Jersey Governor McCrevey, he would resign and spare his party and his office the stress. The idea that this scandal is just "political" as Allen says is so absurd.

What's going to happen is that Allen will run, will win, and then will resign and have the position filled with another Republican.

 

But yeah, it will suck if the election results have to wait for the hand-counted votes. Then again, I'm sure we're not the only county that has some kind of write-in candidate running.

Well it's predictable to see how all these liberals are calling for him to step down when they defended and still defend Bill Clinton. As of today Allen has resigned but for decades we'll have to put up with people defending Clinton.

Oranges and apples. Come on. I am a moderate, former Republican and I wanted to see his ass gone. He is in a position that holds a moral obligation.

 

How can he come after Larry Flint while he is fucking around? Hypocrisy! He needs to go and I am glad to see he pulled his name from the November elections.

The moving vans moved him out over the weekend and he now lives in Blue Ash. I guess if you can verify that you own/rent a place in which you will live in Hamilton Co. by Monday's 4 PM deadline, then that constitutes residency.

No. It was too late to get on the ballot' date=' but people/issues can still be removed from the ballot. The slots for prosecutor will be empty.

I’m sure what you said about those smoky back a rooms is right. The Republicans probably want to get another person in statewide office so when all the Republicans play the political version of musical chairs, there will be more candidates to choose from that have statewide name recognition.

Everyone in elected office should have their personal lives in order. My uncle knows Allen (and Deters) and speculated when I was talking to him last week that the woman actually was coming on to him, etc., but whatever the scenario we agree Allen still needed to resign.

I agree, and Clinton should have resigned when he ran a "family values" campaign and advocated the V-chip (which, btw, my parents have, and it erratically blocks out C-span, the History Channel, and infomercials while letting BET run full throttle at all hours [or so I've heard]). It should also be mentioned that Republican women lost what respect they still had for women's organizations like NOW when they did not come out against Clinton.

Former Hamilton County Prosecutor Mike Allen spends most afternoons hunched over his desk on the 14th floor of the Federal Reserve Building in space about 1/20th the size of his former office across town.

 

At his back is a view of the waterfront and Paul Brown Stadium.

 

A new tenant, his walls are mostly white save for a couple of framed pictures and his college and law diplomas.

 

Photos dot a shelf across from his desk. They're mostly of him with his wife and two children, but there is a glossy color shot of him with President Bush at a local fundraiser, the lone reminder of his days as one of Hamilton County's most powerful politicians...
