That's messed up.  And the interior space looks strange.  The wood paneling from Grandpa's living room is everywhere!

Crazy thing is I wonder if they got permission to use the flamingo statue in those renderings.  I can tell you with 100% positivity that if the artist discovers the renderings, they'll be sued out of their minds....because it has happened.

No, that's not actually true.  The buildings are ancillary subject matter to the main focus of the rendering...the new tower.  If this was the case, nearly every architecture firm would be sued by now.  However artwork is protected under different copyright law and is protected from being misrepresented.

nope it could be very true. try using the chrysler as an ancillary building in a for profit image, your firm will hear about it, in court if necessary and they will lose. it totally depends on how the image rights are secured. of course most owners, even of iconic structures, havent bothered aquiring or enforcing image rights like the chrysler building does, but they will - its the future. technically you cant even have a photo of chrysler on uo if uo is at all for profit. i know this stuff because my spouse and friends work at getty images. image rights are definately an evolving/growth topic and any advertisers should be very careful before they put expensive, image laden ads out there.

edit - here is a list of some particularly litigious owners who have image rights control over their properties:

My first glance at the photo of the towers gave me a shudder, and I still try to avoid looking at it when I visit this thread. If I lived there, I don't think I'd be able to be where I could see them. The architect ought to be expelled/blacklisted from any professional organizations and any licensing or certification should be annulled.

Why I've never shopped at WalMart!  The strangest people shop at WalMarts.

Wow, I've actually been to that Walmart.  When I had a plant in Tulsa, I stayed right next door.

Walmart's not so bad in more suburban areas (Chardon, Macedonia) during the wee hours of the morning, in my experience.  Chardon was great, Macedonia's okay.  Bedford's terrible at any time.

Notice the words on this list.  "alleged", "may."  No only that, but we don't know what courts ruled in favor on that list.  Furthemore, most of the items on that list are logos and signage..... Not Architecture.  Everyone knows better than to slap a building with a bank of America logo into a 3D rendering, why would they want to?

The particular ones that raise questions are the Chrysler building, Rockefeller Center buildings only, Flatiron, and superdome.

This is just an example of legal paranoia and unusual interpretation to attempt to impose unreasonable restrictions.  Fortunately, there's a 99.99999999999999999% you will never find yourself faced with this kind of problem.

The closest I've seen this issue arise first hand was with the inclusion of real life buildings into the SimCity game.  Modeling the architecture exactly was OK.  Using the building names, not so much.  Seems fair to me.

^ well there are more buildings than that early list and more to come, but #structures is a tangent, i think you miss the point. its all about how and where you use the legally rights controlled images. if used on a for-profit website or ad you have to pay. people pay all the time, the structure itself is the 'brand' and the rate varies by the use. thats one way stock agencies like getty, corbis, etc. and the of course also the image rights controlled landmark owners make money. now if you are playing w/ disneyland or flatiron in simcity or are posting on some .edu sites no worries.

Seriously enough.

Yes, the website you posted merely listed buildings and places that have been a part of litigation. It doesn't mean building owners were successful at stopping an image of a trademarked building from going to market.

The 1990 Law covering 3-Dimensional Architectural works stops short of mentioning a representation of an architectural work from a visible location in a 2D application.  Furthermore, as an accessory to a rendered scene, it's not convincing that the author of that image claims control over that trademark to confuse viewers over what is official.  I mentioned art in my initial post, because art falls under different protections than buildings.  Furthermore its a case of copyright vs trademark which is different.  Architectural drawings are copyrighted, buildings are trademarked.

When Anish Kapoor's "Cloud Gate" (the Bean) in Millennium Park was new, security guards stopped people who attempted to use tripods when photographing it, saying that the sculpture is copyright-protected art. They didn't interfere with hand-held photography, so I suppose they assumed that anyone using a tripod was a professional photographer with commercial use in mind.

I've taken quite a few hand-held photographs of it at various times of day and year, and have never been approached by security. I haven't heard any reports recently about prohibiting tripods.

My favorite quote from an article about the possibility of banning texting while driving.

From someone who lives in Cleveland who is against banning it.

""I get so much work done on my cell phone while I'm driving, I drive long distances,""

I'm so disappointed to see that the Detroit M1 Rail line is getting replaced by busses. I'm disappointed in the Secretary of Transportation and Mayor Bing.

I'm also disappointed in the person I saw driving a BMW this morning with the license plate PWR HGRY.

Nice.  I wish they would have included how ridiculous the spelling "rediculous" is, and the fact that someone who dominates is dominant, not dominate.

i guess seriously not enough since you went on after writing that? so its not about who is being sued, the outcomes, 1990, trademark, copyright or art, just particular structures. dont get lost in the weeds. literally as we type this entities are paying graduated fees to the stock agencies and owners to use images, be they primary or ancillary, of image rights controlled structures in ads, etc.. now you dont have to believe or like it, but its true. if you try to use one of these controlled building images on something for profit, be it an ad or website or whatever, you will hear from the lawyers of the more aggressive, protective owners such as disney or chrysler. yes the litigation over image rights is fairly new, but they have case law wins and most are paying the fees, so good luck in court because it would be better business sense just paying up than going down that road. thats why most just pay.

Hmmm, installing this laminate on the countertops in my apartment is not easy stuff.  I need to heat the stuff to make the curves.  I haven't dripped glue on the floor yet!

Aw Damnit!

  • 2 weeks later...

I kept hearing water running – turning on intermittently and running for short periods, and then turning off. I suspected the toilet in the upstairs bathroom. I checked, and sure enough, the tank flapper was causing the problem. When I turned off the water and took out the flapper, the rubber wasn’t pliable any more; it was stiff and looked bleached around the edges. I use those Clorox toilet tabs to prevent stains and rings in the bowl, and the rubber flapper didn’t stand up well to the chlorine.

So what it all came down to; the clorox zapped the flapper in my crapper.

FYI: The 3M headlight restoration kit works like a dream. Don't waste money on having a shop do it for you. Just spent a little over an hour and my headlights are 100 times better than they were before...

I haven't needed to do that yet, but I saw a kit for headlight restoration in the Eastwood catalog. I've bought quite a few things from them over the years, mainly sandblasting and welding supplies, and found all my purchases to be good quality. I would expect their headlight kit would be good too.

^ I remember having problems with the tank toilets all the time when I rented in several old homes during college.  My current apartment had a new toilet installed, but they kept the pressure valve system from the 1920's that you see in commercial toilets.  I got rid of my plunger, never needed it.  If you do end up managing to plug the toilet...run.  The plumbing is about to explode.

Why didn't someone remind me that a birthday party for 45 toddlers is a maddening experience?  Oh, thats right, I didn't ask!  DUH!

I have tried 2 different places to set up a new forum (including Free Forums) for a private group of Moms who want to move off of my moms board and onto their own board. This is so completely difficult, I give up. There are hundreds of settings and I cant' figure out how to do anything. I have newfound respect for our board creators and moderators.

^Yahoo Groups is pretty easy

I think I need more functionality than a group like that would provide. Basically like everything we can do here. Post pictures, links, smilies, private message each other, etc.

I used it for many, many years as a the site for the student chapter of the American Planning Association at CSU. In fact it is still up.

It does all of those things. In some ways, I find it has better functionality than Simple Machines.

Thanks. Maybe I will take a closer look.

google groups is so easy.  This is what my family uses.

Im quitting my job in offshore oil pipeline construction, and taking a job in a nuclear plant in New Orleans

Im quitting my job in offshore oil pipeline construction, and taking a job in a nuclear plant in New Orleans

Congrats.  I hope you like living the rest of your life with only one ball!  LOL

Both sound like interesting jobs to me!

So fast forward about a month to today and I still have temporary counters in my apartment because I bombed my counter lamination project. The stupid propane torch went out when I was halfway bending curvres and though I tried to bend it warm it failed.

I'm now thinking Corian or granite. I got quoted about the same for $60 / sq ft for materials only.  Which do you recommend?  Labor on this is more heavy duty and will have to be done by my landlords staff

Opossum takes subway ride in NYC

NEW YORK -- A suspicious passenger of the four-legged variety led to the evacuation of a New York City subway car.

Startled riders aboard a Manhattan-bound train spotted an opossum curled up underneath a seat near the train's heating duct around 4:30 a.m. on Friday.

The New York Times reports the animal apparently boarded the train at Coney Island in Brooklyn, where the platform is above ground. The subway car was evacuated several stops later in Manhattan as officers wearing heavy gloves tried to remove it. When the marsupial bared its teeth at them, animal control experts were called in.

I would have assumed this was commonplace.

Its a warm place. Its late at night, not many people around. The doors open. Nature takes its course.

It's not like the station is in a wooded area.  First, you need to move upward from street level, then there is an intermediate level from the pay area to a second set of stairs that leads to the the train platforms.  I think the possum got on the train near one of the Prospect Park stops or near the CI rail yard since there are some protected park/wetlands near it.  The critter could have crawled up onto one of the nearby platform and boarded as the train was going toward CI.  Since late a night most people sit in the middle of the train.  Nobody noticed it until the train was heading back toward Manhattan.
