I just didnt like what I saw with his turnovers and missed shots, often when he should have passed instead of shot. Thanks for clearing that up. I always tried to figure out what it meant, trying to link it to the players individual stats which I could never seem to make sense of.

November 10, 201014 yr No, it's not the Cavs' slogan. It was around long before the Cavs even existed. Suppose I started a pee-wee football team and adopted "winners never quit, and quitters never win" as my team's slogan. I could not sue somebody who subsequently used that slogan.

If the requirement of trademark required that a phrase or string of words not have any prior use the entire concept of trademark wouldn't exist. Again referencing WFNY what really set people off about the cover was the combination of the slogan and gold trim on the red jerseys. Someone in the comments there offered up that the Miami Heat apparently have added gold to their color pallete on their alternative uniforms. But prior to that knowledge the slogan plus "wine and gold" in the context of the NBA would lead people (OK probably only Cavs fans) to think of the Cavaliers when they see this. But then it's all moot because SI would be protected by claiming it's a parody even though it probably was just purely innocent use of the Heat's alternate jersey color pallete.

Boy... where's tedolph when you need him? :wink: You're right about the parody exception. But I think it also falls under a 'prior art' (or whatever equivalent is used in this context) exception. Now, the NBA may have some internal rules/laws which apply, but I'm not sure they would be applicable to SI. Bottom line, the Cavs will do nothing about it, nor should they.

November 11, 201014 yr So I went to the game last night. First one I made it to this year and missed much of the first half due to that traffic jam on I-90. I get there and take my seat, look to my right (where the seating for the media members is located) and two feet away is none other than Aaron "the Hater" Goldhammer from WKNR. I said what's up to him and he was pleasant in return. He did, though, twirl his hair the ENTIRE game (at least the portion I was there for).... just like they always tease him on the radio.

November 24, 201014 yr The Cavs need an emotional leader on the court. I'm not sure who that could be right now, but I feel like that is what's missing because at times, they can play really well. But when they start playing poorly, nobody stops them from unravelling. I was hoping Jameson or Williams would step up, but Jameson looks done and Williams has been hurt (not sure he has it in him anyway).
