Posted January 1, 200916 yr I hate New Years. As far back as I can remember, New Years eve has always sucked for me. When I was younger my parents always had lame parties, when I was in high school there were those awkward parties where I wondered if should drink or not and this year it just blows not having anyone special to share the night with anymore.....the feeling of losing your girlfriend sucks even more when you spend the entire ride home debating who would win in a fight between the Starship Enterprise E and a Star Destroyer from Star Wars. Despite my bad mood, I got to have a great time with two old friends and got to enjoy myself downtown. (Star Trek Universe so totally wins that battle btw ;) ) While New Years at Fountain Square is no New Years at Times Square, it was a good time. One bad thing: At 11:58 PM they cut the video feed of Dick Clark on ABC to a live feed at Fountain Square. There was no countdown, no music, just nothing. People checked their cell phones and started shouting. THen some random fireworks went off. At 12:03 AM a countdown appeared on the screen, once that one ended people cheered again. About 4 minutes later some more fireworks went off and that display was impressive. Despite the technical glitch, people went nuts and there was a lot of good, safe, fun. Everyone downtown was nice except two people: -A panhandler who picked a fight with me and grabbed my arm. (Thanks CPD for giving him the boot.) -Some D-bag who tried to tell me I needed his permission to take his picture, when I informed him it was public property he said "he was a lawyer." I laughed, told him Happy New Year and went about the festivities. We killed time until things settled down a little, finally caught a train that wasn't jam-packed, and ended up on a car being terrorized by three drunk thugs. Fortunately my invisibility cloak worked perfectly that night.

Looked like the photographer/writer went down there around 6, during setup, and couldn't be bothered to wait for the larger crowds to arrive.

If you're selling those pictures or prifiting from your site, you do technically need a model release if someone is prominent in the picture.

January 2, 200916 yr lol. I like looking up random laws. Why do lawyers act like they know all of the stipulations of every single law? They think they can end any feud by saying "I'm a lawyer - I'll sue you". He was probably like an immigration or securities lawyer. Would you listen to a Urologist tell you about your thyroid and cortisol levels?

It was too cold for me, instead I accidentally watched the dropping of the Peach in atlanta online instead of the ball in NYC.... :cry: Which gave me this killer idea.... WE NEED A Flying Pig Drop! or Turkey drop?? Somebody take my idea and run with it. I would go down for sure to see that no matter how cold.

My experience has been that when someone feels the need to say during n argument that they know something because they're a Lawyer, they usually aren't.

I would need a model release if I was selling the photographs for commercial use such as stock photographs, however for editorial use and since he was in public view, I do not need a model release. exactly. also, some of the structures could also be image rights controlled (ie., the fountain should be -- if the city was wise -- maybe it's image is controlled? anyone know?). so then you would need to pay a fee based on what commercial purpose you are using that for too. unlikely, but its a growing phenomenon. i know this topic because my spouse did it for a living for getty images for 3-4 yrs. however, as you say, editorial and not for profit, and small audience, she agrees likely no problems.
