Westlake Detective Indicted After FBI Investigation

Posted By Doug Brown on Tue, Jun 30, 2015 at 2:49 pm

An officer with the Westlake Police Department was indicted in federal court today, according to a news release by the U.S. Attorney's office.

Detective Robert Toth, 48, is accused of excessive force on an arrested person and then lying about it on the arrest report and then to a "federal law enforcement officer" who was investigating the arrest. Toth arrested the person — identified only as "T.A." in the news release — on April 24, 2014, and then lied about what happened.

Toth's indictment is not yet entered into online court records, so we're just going off what is in the news release. We will update this when we have more information. Here's how the attorney's office explains the charges:

I forgot to lock my car in Downtown Kent today.  Someone went rummaging through my center console and took a pack of gum and a roll of masking tape.

In the four years I lived in Kent, my car was broken into three times in the mid- to late-1980s. In the second break in, they smashed a side-rear window but couldn't get the stereo out of the dash. So two nights later came the third break-in. They peeled back the plastic covering where the window had been and used a crowbar to pry apart the dashboard which exploded it into a million pieces that littered the inside of the car. Many of our neighbors at Oak Haven Condos in South Lincoln suffered car break-ins too. The neighbor across the hall sat on the roof of the building with a cordless phone for a couple of nights until he spotted someone breaking into a car. He called police and seconds later, the thieves dropped everything and fled in a car before police arrived. Apparently they had a police radio scanner. We never heard if anyone was caught.

The St. Monica's carnival, an institution in Garfield and Maple Heights, had problems with fighting teens again this year.  A volunteer posted Sunday:

"St. Monica's Carnival is open today until 9:00 as long as it is safe. If the police sense any trouble we will close. After much discussion, they have decided that today will be the final carnival after decades here in the community. Such a bitter sweet feeling and my heart is heavy because I have been coming here since I've been a child and been volunteering for the past 15 years. Thank you to the Garfield Heights Police Department and the Auxiliary Police Department for their exemplary service and their peaceful and calm heads during a very chaotic and dangerous situations at times. Thank you to all the volunteers over the 50 plus years who have stayed and worked during the sunshine, rainstorms, tornado warning and the changing times. You are the backbone of this parish and community. Lastly, thank you to all of you who have come and supported the carnival and the St. Monica community and parish. Whether it was to ride the rides, eat the food or take a chance at winning a prize or just to visit your neighbors, family, friends and fellow parishioners...you are the reason the carnival has lasted all of these years. Thank you and God Bless you all."

Sad, but not surprising. More and more of these carnivals in the inner-ring suburbs seem to be ending. St. Gregory in South Euclid has also had trouble in recent years with their festival, though I don't believe they've decided to stop hosting it.

Oh, I stand corrected. I must have missed that or forgotten. It was a mess over the past few years.

Great, now all the kids in that area will have one less thing to do to keep them out of trouble, because we can't control the few who will start trouble no matter what.

This is a one weekend a year event to raise money for the church.  The kids in question were not spending money, they were hanging around looking for trouble.

It's not the church's job to try to keep them out of trouble, but their parents'.

Now there's some online question about whether or not it is going to be cancelled, or changed significantly.

Was there a general admission ticket you had to buy?  As I remember, carnivals only cost money if you want to buy tix to ride the rides or play the games. A general admission fee might dilute the issue of loitering

Apparently Painesville has been a "Sanctuary City" since 2007.  This could go viral nationally if the suspect is an illegal.

Agreeing with E Rocc above, this is a one weekend deal, so it's a bigger loss for the more permanent fixtures in the church communities. The parishes (if they chose to do so) would be better off serving local youth by offering more frequent activities such as sports leagues, arts/craft, performing arts, etc. I'm not saying that they should, but if they were looking to help keep youth in the community occupied and build more meaningful connections, that might be a better route to take.

Was there a general admission ticket you had to buy?  As I remember, carnivals only cost money if you want to buy tix to ride the rides or play the games. A general admission fee might dilute the issue of loitering

This is pretty close to the idea I had, general admission.  Perhaps you get equivalent value in ride/games tickets.

Or even offer what the Lake County Captians do with their playground:  unlimited rides with a wristband.  I made out on that deal with my daughter lol.

Wristbands would have to be part of it or else kids would just find a way to sneak in without paying.

Apparently Painesville has been a "Sanctuary City" since 2007.  This could go viral nationally if the suspect is an illegal.

I certainly will, at least in the conservative media, which would be highly hypocritical.  It is akin to the cries from the gun control crowd each time there is a mass shooting...... taking a single incident and using it to allege a widespread problem.

But it's not a single incident in light of the Kathryn Steinle case.  Also, it would be more akin to cities saying they would refuse to enforce the NFA of 1934 (let alone the GCA of 1968), refusal to address an issue at a very basic level.

Apparently there's still a lot of controversy over that. I think the city council (& city manager at the time) decreed Painesville to be a sanctuary city, basically welcoming Mexicans to move there with open arms, much to the chagrin of many residents. I can never seem to find much info online though. One website, sanctuarycities.info (one of those right wing wacko websites ), lists Columbus and P'ville as the only ones in Ohio, but there must be more. Although I once found a national list and could find no Ohio cities. Whatever the case, this is not a good story. The majority of Mexicans in there are hardworking, law-abiding citizens, but if you're here illegally, well...

And Trump will be here next week for the debate....

I know, the timing couldn't be better for Trump. It's almost like he engineered this whole scenario. But maybe it will finally wake up even Democrats to the immigration problem and force them ask the hard questions. Again, no one has anything against legal immigrants, and even most of those here illegally don't commit crimes. (As an example of how diverse the Mexican population is in Painesville, this year a young man from that community graduated as the valedictorian of his class and will be attending Cornell in the fall) But unfortunately if even one person--legal or illegal--is involved in something this horrific it reflects badly on the whole community, and throws a spotlight on how messed up our immigration policies are.

So how did he get the gun? Or are we only interested in overreacting to low-frequency, high-profile crimes when it comes to certain issues and not others?

How did he get a driver's license, or allowed to drive away (after being pulled over) if he did not have one?

they gave this case to Judge Cicconetti!!? I wonder what "creative" punishment he's going to get? the guillotine?

official statement in an attempt at damage control by HOLA (Hispanic Organization of Lake and Ashtabula) Not an issue of immigration, but of mental illness!--

"HOLA Ohio, a grassroots Latino organization based in Painesville, has released the following statement:

The Latino community is distraught and deeply saddened by the violent acts committed by Juan Razo. Our hearts are broken and we are praying for the victims. Juan Razo’s family has grappled with his serious mental health issues for many years. His acts do not represent our community. We want to thank law enforcement for their excellent work of removing this threat so quickly. In addition, Juan Razo was not a random illegal alien. His father is a U.S. citizen who has worked in the fields for 40 years. He filed documents for his children over a decade ago and Juan Razo was a beneficiary with an approved petition who has been “standing in line” for his green card for over 12 years. Thus, this is not an issue about immigration, rather it is about the problems associated with adults with mental illness. We are disappointed to see leaders exploiting this tragedy to promote a political agenda."

So he was on the waiting list, but here anyway.  With mental issues that might have blocked the actual issuance of the card.

FYI my friend was assaulted and robbed Tuesday night in Lakewood at Madison and Winchester. Suspect is a kid (aged 15-18 is his guess) on a bike, African American.

IMHO this is a rare thing and this is generally a very safe neighborhood.

If I venture over to Lakewood anytime soon, I will be on the lookout for a person matching that description.

maybe, or it may have booted him to the top of the list. Here's a good article from 9 years ago, a profile of the Mexican community in Lake County. Despite whether or not Painesville is officially a sanctuary city, illegal immigrants basically had the red carpet rolled out for them. Again, overall I think Mexicans have benefited the community (best Mexican restaurants in the Cleveland area!--sorry), and something like this tragedy may have happened anyway with this guy--legal status notwithstanding--but the fact that he was not legal means that it would have been prevented if authorities were acting according to the law.

West Shore experiences wave of thefts from vehicles

FAIRVIEW PARK, Ohio — West Shore cities experienced a wave of vehicle break-ins in recent days.

Most of the vehicles were left unlocked and thieves mostly targeted cash, electronics and other loose items, according to police.

The reports came in from all areas of the  West Shore, but many were clustered in certain areas. For example, six people told Fairview Park police that items were taken from their vehicles while they were parked near Lawn Village Apartments on Lorain Road July 25.

Just spoke to my friend, it's not the same assailant. I'm not at the point where I'm gonna say East End isn't safe. But let's put it this way, when I'm walking down the street I'm profiling people now, and I don't feel good about it.

^Aren't they all?

Always think of it like this: How might the outcome have been different if the assailant was using a knife.

^I don't know how successful such an elderly man would have been in a knife attack.  Nor would a man standing with a knife been such a threat to police.  In addition to physical limitations, I think I have also read about the psychological differences of killing someone with a knife vs. a gun.  Killing someone with a knife requires a lot more hatred and passion.  Society is somewhat more desensitized to shooting.  Plus, you don't have to feel the bullet cutting through flesh and bone.  It's why some real maniacs actually prefer a knife.

^^It's a deadly combination.  Unfortunately, we can't do anything to prevent that without spitting on the constitution and pissing on the graves of American soldiers.

Thieves trying to break in while residents home

Thieves are targeting homes in Rocky River. Police say they're trying to break into houses, and it seems to be a pattern in other suburbs on the west side, too. Police say the suspect or suspects try to enter houses at night, even when people are home. They are cutting off screens to windows and doors to try to get inside. Now residents are having a hard time sleeping at night. On the south side of Rocky River, everyone seems to know their neighbors. Now they're watching out for each other even more. "Neighbors have all been talking and texting and getting the word out," said one neighbor who didn't want to be identified. Police say thieves have broken into or tried to break into several homes off Wooster Road.
