To TheDonald,  I appreciate the info you also gave on him.  I've been doing a lot of research and actually found most of the info that you provided.  I, again, emailed him but don't expect anything back.  What really bothers me about this guy is that his website is still up and people can purchase from it.  How much money has he stolen from people who order form his website?

Duke Energy asks for dismissal of 'kickback' lawsuit

Duke Energy Corp. has filed for the dismissal of a class-action complaint claiming that it has been overcharging tens of thousands of residential and business customers because of illegal kickbacks given to large corporate customers.

 

The lawsuit was filed in January by Cincinnati attorneys Randy Freking and Stan Chesley. It outlines an alleged illegal scheme by Charlotte, N.C.-based Duke and its predecessor companies Cinergy Corp. and Cincinnati Gas & Electric Co. to funnel kickbacks to unidentified corporate customers in Greater Cincinnati in exchange for their withdrawal of opposition to rate increases that Duke sought from Ohio regulators.

 

Duke, in its filing, said that "there is no basis for any claim under federal or state law" for the lawsuit.

Duke Energy fought back against an antitrust lawsuit Friday with a strong denial that it schemed with big corporate customers to raise rates for everyone else.

 

The utility's response, filed in U.S. District Court, described the lawsuit as "utterly baseless" and said its request for higher rates was thoroughly reviewed by state regulators and the Ohio Supreme Court.

Duke officials said those reviews found no evidence that contracts the utility signed with about 20 corporate customers influenced approval of a rate increase Duke requested in 2004. The suit claims the contracts called for Duke to pay the companies kickbacks in exchange for their support of the rate increase.

 

The Public Utilities Commission of Ohio approved the higher rates, which resulted in a 30-percent increase for residential customers.  "Our rates have been upheld," Duke's chief legal officer, Marc Manly, said in a statement Friday. "There is no basis for the lawsuit and it should be dismissed at the outset."

 

He said Duke did nothing wrong and the lawsuit should be thrown out because federal antitrust laws do not apply to state regulation of utilities.  Stan Chesley, one of the lawyers who filed the lawsuit, said antitrust laws do apply to the case.  Ultimately, Judge Edmund Sargus will make the call.

Randy Freking and Stand Chesley are the two toughest attourneys in the area.  Duke is going down. 

Why would large corporations support a rate increase WITHOUT kickbacks? People respond to incentives d@mnit, and no one wants to pay more than they have to! Especially to an energy conglomerate!

What I would probably do is send a registered letter to that person and address demanding fulfillment of the order, and state that you will inform the Ohio state attorney general of the matter if he doesn't pay up. Also (grasping at threads) if that address is in the city limits of Wilmington I would call the local PD and explain the matter.

You're right, anything is possible.  It still doesn't make sense to me that he would send me a very apologetic email stating that they were having computer errors and that they would ship my product to me asap and also said that he hoped that it wouldn't hurt our business relationship in the future. So who knows, maybe something did happen to the guy.....

 

I do plan on sending a registered letter.  We'll see what happens from there...

Y'know, every time I'm around some real churchy or conservative people and they say "let's play CORNHOLE!!!" I really wince. I'm NEVER going to get used to the name of the game!  :evil:

What is going to be the effect of this lawsuit?  I mean, are they going to make Duke go back and retroactively reduce the price of energy since the increase and credit customers' accounts accordingly?  Or are they going to just make them stop sending these payments to the companies they made agreements with?  Because if it's the latter, that doesn't teach Duke anything.  If they didn't give these payments, the companies would have opposed the rate increase, meaning that it potentially wouldn't have been passed by PUCO, resulting in lower energy prices for everyone.  I basically see no point in this lawsuit unless Duke is going to be forced to give some money back to all of its customers.

I think I speak for everyone in Cincinnati when I say WE WANT REPARATIONS!

Local unemployment falls in Feb., keeps pace with U.S. rate

Most of the economy's news has been bad lately, but there's a ray of sun cutting through the dark clouds.  Local unemployment has improved from a year ago and held even with the national average the past few months, a departure from the prior three years.

 

Cincinnati's February unemployment rate dipped to 5.2 percent from 5.4 percent a year ago, according to newly released figures from the Ohio Department of Job and Family Services that are not adjusted for seasonal factors.  The U.S. jobless rate was also 5.2 percent in February when not seasonally adjusted. And job growth in Greater Cincinnati, which has markedly lagged the U.S. growth rate, pulled slightly ahead in February.

But seriously... Cincinnati just keeps plugging away with solid, steady economic performance... and it did benefit by not having the dramatic post 9/11 losses that a lot of other regions suffered.  If you ignore the ridiculous sprawl-fueled growth of the sunbelt "gas giants"... Cincinnati looks pretty good.

I am happy Cincy is trending back in line with the US - I think these next few years are going to be important and telling as the area continues to shed jobs in the sectors at risk and the growth sectors become more prominent.

Rookwood Pottery moving close to Findlay Market

OVER-THE-RHINE - Grand plans are in store for an 80,000-square-foot building near Findlay Market that's expected to be the new headquarters for the Rookwood Pottery Co.

 

Martin Wade, owner of the recently reopened Grammer's restaurant in Over-the-Rhine and financial partner of Cincinnati restaurateur and chef Jean-Robert de Cavel, finalized a roughly $500,000 deal Monday to purchase the 106-year-old building at 1920 Race St.

 

Wade said he's been inspired by the work and plans of Cincinnati artist Chris Rose, who purchased the remaining assets of the original Rookwood Pottery from Michigan collector Art Townley in July 2006.

 

"It's one of the gratuitous things. He was looking for bigger space, and he's passionate about Over-the-Rhine," said Wade, who owns more than a dozen pieces of property in the neighborhood. "We perceive this to be something that will be good for the city and great for Rookwood."

I saw it!  Although I might have missed it if a guy on the other message boards didn't let me know.  It makes me a little nervous that I used the owner's name in my letter.  It just makes me so mad that he's ignoring every email and phone call so he deserves what he gets.

 

I am originally from western PA and i'll be there for a 6 wk stay in the next couple of months.  I've thought about driving the 4 hrs. to Wilmington and walking into his store.  You never know, maybe I will do just that!

I am not a lawyer, but - if he conducted business through an LLC or a corporation, then all you have to go against are the assets of the company. If it's a sole proprietorship, then he's personally responsible, BUT, bankruptcy would probably invalidate any such claim. And again, IANAL.

 

How did you pay for this? Check, money order, Paypal, or credit card? Paypal or credit card can be disputed, but only within 60 days of the billing date where the charge appears on the statement. Check or M.O., you're out of luck...

 

I checked their web site. Somebody has removed all of the "buy" links on the product ordering pages.

Well, I'm not too sure about this guy being long gone.... maybe bankruptcy.  I've had other people telling me that they didn't think this guy would run a business this way and I also heard from another person that there is another guy who also owns this business and they see him coming and going from his store and that both of the owners are involved in cornhole competitions around town.

 

I paid by charge card back in December.  I guess I'm out of luck.

 

After reading your post, I went and checked out their website and so now you can't order from them, which makes me feel a lot better anyway.  I don't expect my money back or even the game I ordered but at least it won't happen to anyone else.

So I saw the article that Seth Cox wrote to the paper...

 

I don't believe for one minute I will see the product that I ordered.  Of course he's playing the victim.  I am not the first person this has happened to according to the BBB so he has done this in the past.  If he had 5 minutes to respond to my letter in the paper, then why couldn't he respond to just one of the many emails I've sent to 3 different emails addresses I have for him?  Also, I have stated that if it's easier to refund my charge card than to ship out the game, then I would be o.k. with that too.  I have been nothing but nice in every single email and voice mail to him and he refuses to respond me.  At least I got some kind of response from posting in the paper, but it's unfortunate that I had to let the whole town of Wilmington know how he runs his business.  It was never my intention to bad mouth him or put his integrity into question. I just want my $165 back.

I'd do three things at this point. First, write a rebuttal letter to the editor and methodically list the timeline of how you attempted to resolve this. Second, talk to your credit card company (and I have no idea why you let this go so long - that's the whole point of credit cards - chargebacks.) With some luck it will help get his credit card processing shut down. Third, file a formal complaint with the state Attorney General against the guy. I did this once when my phone bill was being slammed with charges from a pay phone booth in Chicago by some long distance company. The Attorney General will force the guy to  account for how he expedited your order.

It's a CORNHOLE SET! make one or spend another 50 bucks or so and get over it!

Just an update.  I finally talked to the owner of Cornhole Etc. and should be receiving my game in the next week or so.  I was probably WAY too nice to him but my persistence paid off.  I had a rebuttal letter sent to the paper and it would have been posted tomorrow, but since I talked to him and straightened everything out, I decided to pull it.  Thanks exurbkid for the suggestion of writing a letter to the editor.  It really was the only way to get this guy's attention.

ERLANGER - Toyota Boshoku America is adding 170 white-collar jobs here at an average annual salary of $60,000 to $70,000.

 

The company, a supplier to the automotive industry with annual sales of $10 billion, Wednesday announced the expansion of its Erlanger headquarters, which opened in an office park along Interstate 275 last September.

 

The new jobs will include finance, accounting, human resources, production control, purchasing, information technology, sales and corporate social responsibility. The expansion includes 23,000 square feet of new office space in Toyota Boshoku's building in the CirclePort Business Park, bringing the company's total Northern Kentucky footprint to nearly 50,000 square feet and 270 jobs.

Kuntz's latest efforts take high-tech in new directions

Cincinnati USA Partnership makes top 10 list

The Cincinnati USA Partnership has been named one of the nation's top 10 U.S. Economic Development Groups of 2007 by Site Selection magazine.  The Greater Akron Chamber of Commerce also made the cut, and the Wayne Economic Development Council in Wooster, Ohio, got an honorable mention.

 

"We are absolutely thrilled," said Doug Moormann, vice president of economic development for the Cincinnati USA Regional Chamber, which houses the partnership. "It is great recognition for us and our partners and really for the region."

Local jobless rate drops

The jobless rate for Greater Cincinnati and Northern Kentucky for April dipped below the national average for the first time in nearly 3½ years, fueled by the addition of 7,400 new jobs during the month.

 

The rate fell to 4.6 percent for April for the region area’s 15 counties, according to the report released today by the Ohio Department of Job & Family Services. The national rate for April was 4.8 percent in April. The last time the local rate was lower than the national rate was December 2004.

Sencorp, a global maker of construction fasteners, announced plans Monday to move from Newport to a new $19 million headquarters in the 100-acre Ivy Pointe development overlooking Interstate 275.
